Sahih al-Bukhari : 101
Anas ibn Malik (RA)

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ ثَابِتٍ، عَنْ أَنَسٍ ـ رضى الله عنه ـ قَالَ رَأَى النَّبِيُّ صلى الله عليه وسلم عَلَى عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ أَثَرَ صُفْرَةٍ فَقَالَ " مَهْيَمْ ". أَوْ " مَهْ ". قَالَ تَزَوَّجْتُ امْرَأَةً عَلَى وَزْنِ نَوَاةٍ مِنْ ذَهَبٍ. فَقَالَ " بَارَكَ اللَّهُ لَكَ أَوْلِمْ وَلَوْ بِشَاةٍ ".
The Prophet (ﷺ) seeing a yellow mark (of perfume) on the clothes of `Abdur-Rahman bin `Auf, said,
"What about you?" `Abdur-Rahman replied, "I have married a woman with a Mahr of gold equal to a
date-stone." The Prophet (ﷺ) said, "May Allah bestow His Blessing on you (in your marriage). Give a
wedding banquet, (Walima) even with one sheep."

حَدَّثَنَا إِسْمَاعِيلُ، قَالَ حَدَّثَنِي عَبْدُ الْعَزِيزِ بْنُ أَبِي حَازِمٍ، عَنْ أَبِيهِ، عَنْ سَهْلِ بْنِ سَعْدٍ السَّاعِدِيِّ، أَنَّهُ قَالَ مَرَّ رَجُلٌ عَلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ لِرَجُلٍ عِنْدَهُ جَالِسٍ " مَا رَأْيُكَ فِي هَذَا ". فَقَالَ رَجُلٌ مِنْ أَشْرَافِ النَّاسِ، هَذَا وَاللَّهِ حَرِيٌّ إِنْ خَطَبَ أَنْ يُنْكَحَ، وَإِنْ شَفَعَ أَنْ يُشَفَّعَ. قَالَ فَسَكَتَ رَسُولُ اللَّهِ صلى الله عليه وسلم ثُمَّ مَرَّ رَجُلٌ فَقَالَ لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم " مَا رَأْيُكَ فِي هَذَا ". فَقَالَ يَا رَسُولَ اللَّهِ هَذَا رَجُلٌ مِنْ فُقَرَاءِ الْمُسْلِمِينَ، هَذَا حَرِيٌّ إِنْ خَطَبَ أَنْ لاَ يُنْكَحَ، وَإِنْ شَفَعَ أَنْ لاَ يُشَفَّعَ، وَإِنْ قَالَ أَنْ لاَ يُسْمَعَ لِقَوْلِهِ. فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " هَذَا خَيْرٌ مِنْ مِلْءِ الأَرْضِ مِثْلَ هَذَا ".
A man passed by Allah's Messenger (ﷺ) and the Prophet (ﷺ) asked a man sitting beside him, "What is your
opinion about this (passer-by)?" He replied, "This (passer-by) is from the noble class of people. By
Allah, if he should ask for a lady's hand in marriage, he ought to be given her in marriage, and if he
intercedes for somebody, his intercession will be accepted. Allah's Messenger (ﷺ) kept quiet, and then
another man passed by and Allah's Messenger (ﷺ) asked the same man (his companion) again, "What is your
opinion about this (second) one?" He said, "O Allah's Messenger (ﷺ)! This person is one of the poor
Muslims. If he should ask a lady's hand in marriage, no-one will accept him, and if he intercedes for
somebody, no one will accept his intercession, and if he talks, no-one will listen to his talk." Then
Allah's Messenger (ﷺ) said, "This (poor man) is better than such a large number of the first type (i.e. rich
men) as to fill the earth."

Khansa Bint Khidam Al-Ansariya (RA)

حَدَّثَنَا يَحْيَى بْنُ قَزَعَةَ، حَدَّثَنَا مَالِكٌ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ، عَنْ عَبْدِ الرَّحْمَنِ، وَمُجَمِّعٍ، ابْنَىْ يَزِيدَ بْنِ جَارِيَةَ الأَنْصَارِيِّ عَنْ خَنْسَاءَ بِنْتِ خِذَامٍ الأَنْصَارِيَّةِ، أَنَّ أَبَاهَا، زَوَّجَهَا وَهْىَ ثَيِّبٌ، فَكَرِهَتْ ذَلِكَ، فَأَتَتِ النَّبِيَّ صلى الله عليه وسلم فَرَدَّ نِكَاحَهَا.
That her father gave her in marriage when she was a matron and she disliked that marriage. So she
came and (complained) to the Prophets and he declared that marriage invalid. (See Hadith No. 69,
Vol. 7)

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، عَنْ أَبِي عَمْرٍو ـ هُوَ ذَكْوَانُ ـ عَنْ عَائِشَةَ ـ رضى الله عنها ـ قَالَتْ قُلْتُ يَا رَسُولَ اللَّهِ يُسْتَأْمَرُ النِّسَاءُ فِي أَبْضَاعِهِنَّ قَالَ " نَعَمْ ". قُلْتُ فَإِنَّ الْبِكْرَ تُسْتَأْمَرُ فَتَسْتَحِي فَتَسْكُتُ. قَالَ " سُكَاتُهَا إِذْنُهَا ".
I asked the Prophet, "O Allah's Messenger (ﷺ)! Should the women be asked for their consent to their
marriage?" He said, "Yes." I said, "A virgin, if asked, feels shy and keeps quiet." He said, "Her silence
means her consent."

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ عُبَيْدِ اللَّهِ، قَالَ حَدَّثَنِي نَافِعٌ، عَنْ عَبْدِ اللَّهِ ـ رضى الله عنه ـ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم نَهَى عَنِ الشِّغَارِ. قُلْتُ لِنَافِعٍ مَا الشِّغَارُ قَالَ يَنْكِحُ ابْنَةَ الرَّجُلِ وَيُنْكِحُهُ ابْنَتَهُ بِغَيْرِ صَدَاقٍ، وَيَنْكِحُ أُخْتَ الرَّجُلِ وَيُنْكِحُهُ أُخْتَهُ بِغَيْرِ صَدَاقٍ. وَقَالَ بَعْضُ النَّاسِ إِنِ احْتَالَ حَتَّى تَزَوَّجَ عَلَى الشِّغَارِ، فَهْوَ جَائِزٌ، وَالشَّرْطُ بَاطِلٌ. وَقَالَ فِي الْمُتْعَةِ النِّكَاحُ فَاسِدٌ، وَالشَّرْطُ بَاطِلٌ. وَقَالَ بَعْضُهُمُ الْمُتْعَةُ وَالشِّغَارُ جَائِزٌ، وَالشَّرْطُ بَاطِلٌ.
Nafi narrated to me that 'Abdullah said that Allah's Messenger (ﷺ) forbade
the Shighar. I asked Nafi', "What is the Shighar?" He said, "It is to
marry the daughter of a man and marry one's daughter to that man (at
the same time) without Mahr (in both cases); or to marry the sister of
a man and marry one's own sister to that man without Mahr." Some
people said, "If one, by a trick, marries on the basis of Shighar, the
marriage is valid but its condition is illegal." The same scholar said
regarding Al-Mut'a, "The marriage is invalid and its condition is
illegal." Some others said, "The Mut'a and the Shighar are permissible
but the condition is illegal."

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ، حَدَّثَنَا الزُّهْرِيُّ، عَنِ الْحَسَنِ، وَعَبْدِ اللَّهِ، ابْنَىْ مُحَمَّدِ بْنِ عَلِيٍّ عَنْ أَبِيهِمَا، أَنَّ عَلِيًّا ـ رضى الله عنه ـ قِيلَ لَهُ إِنَّ ابْنَ عَبَّاسٍ لاَ يَرَى بِمُتْعَةِ النِّسَاءِ بَأْسًا. فَقَالَ إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم نَهَى عَنْهَا يَوْمَ خَيْبَرَ، وَعَنْ لُحُومِ الْحُمُرِ الإِنْسِيَّةِ. وَقَالَ بَعْضُ النَّاسِ إِنِ احْتَالَ حَتَّى تَمَتَّعَ، فَالنِّكَاحُ فَاسِدٌ. وَقَالَ بَعْضُهُمُ النِّكَاحُ جَائِزٌ وَالشَّرْطُ بَاطِلٌ.
`Ali was told that Ibn `Abbas did not see any harm in the Mut'a marriage. `Ali said, "Allah's Messenger (ﷺ)
forbade the Mut'a marriage on the Day of the battle of Khaibar and he forbade the eating of donkey's
meat." Some people said, "If one, by a tricky way, marries temporarily, his marriage is illegal." Others
said, "The marriage is valid but its condition is illegal."

Abu Hurairah (RA)

حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ، حَدَّثَنَا هِشَامٌ، حَدَّثَنَا يَحْيَى بْنُ أَبِي كَثِيرٍ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " لاَ تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ، وَلاَ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ ". فَقِيلَ يَا رَسُولَ اللَّهِ كَيْفَ إِذْنُهَا قَالَ " إِذَا سَكَتَتْ ". وَقَالَ بَعْضُ النَّاسِ إِنْ لَمْ تُسْتَأْذَنِ الْبِكْرُ وَلَمْ تَزَوَّجْ. فَاحْتَالَ رَجُلٌ فَأَقَامَ شَاهِدَىْ زُورٍ أَنَّهُ تَزَوَّجَهَا بِرِضَاهَا، فَأَثْبَتَ الْقَاضِي نِكَاحَهَا، وَالزَّوْجُ يَعْلَمُ أَنَّ الشَّهَادَةَ بَاطِلَةٌ، فَلاَ بَأْسَ أَنْ يَطَأَهَا، وَهْوَ تَزْوِيجٌ صَحِيحٌ.
The Prophet (ﷺ) said, "A virgin should not be married till she is asked for her consent; and the matron
should not be married till she is asked whether she agrees to marry or not." It was asked, "O Allah's
Apostle! How will she (the virgin) express her consent?" He said, "By keeping silent." Some people
said that if a virgin is not asked for her consent and she is not married, and then a man, by playing a trick
presents two false witnesses that he has married her with her consent and the judge confirms his
marriage as a true one, and the husband knows that the witnesses were false ones, then there is no
harm for him to consummate his marriage with her and the marriage is regarded as valid.

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنِ الْقَاسِمِ، أَنَّ امْرَأَةً، مِنْ وَلَدِ جَعْفَرٍ تَخَوَّفَتْ أَنْ يُزَوِّجَهَا وَلِيُّهَا وَهْىَ كَارِهَةٌ فَأَرْسَلَتْ إِلَى شَيْخَيْنِ مِنَ الأَنْصَارِ عَبْدِ الرَّحْمَنِ وَمُجَمِّعٍ ابْنَىْ جَارِيَةَ قَالاَ فَلاَ تَخْشَيْنَ، فَإِنَّ خَنْسَاءَ بِنْتَ خِذَامٍ أَنْكَحَهَا أَبُوهَا وَهْىَ كَارِهَةٌ، فَرَدَّ النَّبِيُّ صلى الله عليه وسلم ذَلِكَ. قَالَ سُفْيَانُ وَأَمَّا عَبْدُ الرَّحْمَنِ فَسَمِعْتُهُ يَقُولُ عَنْ أَبِيهِ إِنَّ خَنْسَاءَ.
A woman from the offspring of Ja`far was afraid lest her guardian marry her (to somebody) against
her will. So she sent for two elderly men from the Ansar, `AbdurRahman and Mujammi', the two sons
of Jariya, and they said to her, "Don't be afraid, for Khansa' bint Khidam was given by her father in
marriage against her will, then the Prophet (ﷺ) cancelled that marriage." (See Hadith No. 78)

حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا شَيْبَانُ، عَنْ يَحْيَى، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " لاَ تُنْكَحُ الأَيِّمُ حَتَّى تُسْتَأْمَرَ، وَلاَ تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ ". قَالُوا كَيْفَ إِذْنُهَا قَالَ " أَنْ تَسْكُتَ ". وَقَالَ بَعْضُ النَّاسِ إِنِ احْتَالَ إِنْسَانٌ بِشَاهِدَىْ زُورٍ عَلَى تَزْوِيجِ امْرَأَةٍ ثَيِّبٍ بِأَمْرِهَا، فَأَثْبَتَ الْقَاضِي نِكَاحَهَا إِيَّاهُ، وَالزَّوْجُ يَعْلَمُ أَنَّهُ لَمْ يَتَزَوَّجْهَا قَطُّ، فَإِنَّهُ يَسَعُهُ هَذَا النِّكَاحُ، وَلاَ بَأْسَ بِالْمُقَامِ لَهُ مَعَهَا.
Allah's Messenger (ﷺ) said, "A lady slave should not be given in marriage until she is consulted, and a virgin
should not be given in marriage until her permission is granted." The people said, "How will she
express her permission?" The Prophet (ﷺ) said, "By keeping silent (when asked her consent)." Some
people said, "If a man, by playing a trick, presents two false witnesses before the judge to testify that
he has married a matron with her consent and the judge confirms his marriage, and the husband is sure
that he has never married her (before), then such a marriage will be considered as a legal one and he
may live with her as husband."

حَدَّثَنَا أَبُو عَاصِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، عَنْ ذَكْوَانَ، عَنْ عَائِشَةَ ـ رضى الله عنها ـ قَالَتْ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " الْبِكْرُ تُسْتَأْذَنُ ". قُلْتُ إِنَّ الْبِكْرَ تَسْتَحْيِي قَالَ " إِذْنُهَا صُمَاتُهَا ". وَقَالَ بَعْضُ النَّاسِ إِنْ هَوِيَ رَجُلٌ جَارِيَةً يَتِيمَةً أَوْ بِكْرًا، فَأَبَتْ فَاحْتَالَ فَجَاءَ بِشَاهِدَىْ زُورٍ عَلَى أَنَّهُ تَزَوَّجَهَا، فَأَدْرَكَتْ فَرَضِيَتِ الْيَتِيمَةُ، فَقَبِلَ الْقَاضِي شَهَادَةَ الزُّورِ، وَالزَّوْجُ يَعْلَمُ بِبُطْلاَنِ ذَلِكَ، حَلَّ لَهُ الْوَطْءُ.
Allah's Messenger (ﷺ) said, "It is essential to have the consent of a virgin (for the marriage). I said, "A virgin
feels shy." The Prophet; said, "Her silence means her consent." Some people said, "If a man falls in
love with an orphan slave girl or a virgin and she refuses (him) and then he makes a trick by bringing
two false witnesses to testify that he has married her, and then she attains the age of puberty and
agrees to marry him and the judge accepts the false witness and the husband knows that the witnesses
were false ones, he may consummate his marriage."

حَدَّثَنَا أَحْمَدُ، حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي بَكْرٍ الْمُقَدَّمِيُّ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ ثَابِتٍ، عَنْ أَنَسٍ، قَالَ جَاءَ زَيْدُ بْنُ حَارِثَةَ يَشْكُو فَجَعَلَ النَّبِيُّ صلى الله عليه وسلم يَقُولُ " اتَّقِ اللَّهَ، وَأَمْسِكْ عَلَيْكَ زَوْجَكَ ". قَالَتْ عَائِشَةُ لَوْ كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم كَاتِمًا شَيْئًا لَكَتَمَ هَذِهِ. قَالَ فَكَانَتْ زَيْنَبُ تَفْخَرُ عَلَى أَزْوَاجِ النَّبِيِّ صلى الله عليه وسلم تَقُولُ زَوَّجَكُنَّ أَهَالِيكُنَّ، وَزَوَّجَنِي اللَّهُ تَعَالَى مِنْ فَوْقِ سَبْعِ سَمَوَاتٍ. وَعَنْ ثَابِتٍ {وَتُخْفِي فِي نَفْسِكَ مَا اللَّهُ مُبْدِيهِ وَتَخْشَى النَّاسَ} نَزَلَتْ فِي شَأْنِ زَيْنَبَ وَزَيْدِ بْنِ حَارِثَةَ.
Zaid bin Haritha came to the Prophet (ﷺ) complaining about his wife. The Prophet (ﷺ) kept on saying (to
him), "Be afraid of Allah and keep your wife." Aisha said, "If Allah's Messenger (ﷺ) were to conceal
anything (of the Qur'an he would have concealed this Verse." Zainab used to boast before the wives of
the Prophet (ﷺ) and used to say, "You were given in marriage by your families, while I was married (to
the Prophet) by Allah from over seven Heavens." And Thabit recited, "The Verse:-- 'But (O
Muhammad) you did hide in your heart that which Allah was about to make manifest, you did fear the
people,' (33.37) was revealed in connection with Zainab and Zaid bin Haritha."

حَدَّثَنَا خَلاَّدُ بْنُ يَحْيَى، حَدَّثَنَا عِيسَى بْنُ طَهْمَانَ، قَالَ سَمِعْتُ أَنَسَ بْنَ مَالِكٍ ـ رضى الله عنه ـ يَقُولُ نَزَلَتْ آيَةُ الْحِجَابِ فِي زَيْنَبَ بِنْتِ جَحْشٍ وَأَطْعَمَ عَلَيْهَا يَوْمَئِذٍ خُبْزًا وَلَحْمًا وَكَانَتْ تَفْخَرُ عَلَى نِسَاءِ النَّبِيِّ صلى الله عليه وسلم وَكَانَتْ تَقُولُ إِنَّ اللَّهَ أَنْكَحَنِي فِي السَّمَاءِ.
The Verse of Al-Hijab (veiling of women) was revealed in connection with Zainab bint Jahsh. (On the
day of her marriage with him) the Prophet (ﷺ) gave a wedding banquet with bread and meat; and she used
to boast before other wives of the Prophet (ﷺ) and used to say, "Allah married me (to the Prophet (ﷺ) in the
Heavens."

وَحَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، وَابْنُ، بَشَّارٍ قَالَ ابْنُ الْمُثَنَّى حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، حَدَّثَنَا شُعْبَةُ، عَنِ الْحَكَمِ، عَنْ عُمَارَةَ بْنِ عُمَيْرٍ، عَنْ إِبْرَاهِيمَ بْنِ أَبِي مُوسَى، عَنْ أَبِي مُوسَى، أَنَّهُ كَانَ يُفْتِي بِالْمُتْعَةِ فَقَالَ لَهُ رَجُلٌ رُوَيْدَكَ بِبَعْضِ فُتْيَاكَ فَإِنَّكَ لاَ تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي النُّسُكِ بَعْدُ حَتَّى لَقِيَهُ بَعْدُ فَسَأَلَهُ فَقَالَ عُمَرُ قَدْ عَلِمْتُ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَدْ فَعَلَهُ وَأَصْحَابُهُ وَلَكِنْ كَرِهْتُ أَنْ يَظَلُّوا مُعْرِسِينَ بِهِنَّ فِي الأَرَاكِ ثُمَّ يَرُوحُونَ فِي الْحَجِّ تَقْطُرُ رُءُوسُهُمْ .
And Muhammad ibn al-Muthanna and Ibn Bashar narrated to us. Ibn al-Muthanna said: Muhammad ibn Ja'far narrated to us, Shu'bah narrated to us, on the authority of al-Hakam, on the authority of 'Umarah ibn 'Umayr, on the authority of Ibrahim ibn Abi Musa, on the authority of Abi Musa, that he used to issue fatwas permitting temporary marriage (mut'ah). A man said to him, "Be patient with some of your fatwas, for you do not know what the Commander of the Faithful has introduced regarding the rituals of Hajj." Then he met him again and asked him, and Umar said: I know that the Prophet, may God bless him and grant him peace, did it, and his companions, but I disliked that they should remain with them in the Arak trees and then go on Hajj with their heads dripping.

حَدَّثَنِي عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ أَسْمَاءَ الضُّبَعِيُّ، حَدَّثَنَا جُوَيْرِيَةُ، عَنْ مَالِكٍ، عَنِ الزُّهْرِيِّ، أَنَّ عَبْدَ اللَّهِ بْنَ عَبْدِ اللَّهِ بْنِ نَوْفَلِ بْنِ الْحَارِثِ بْنِ عَبْدِ الْمُطَّلِبِ، حَدَّثَهُ أَنَّ عَبْدَ الْمُطَّلِبِ بْنَ رَبِيعَةَ بْنِ الْحَارِثِ حَدَّثَهُ قَالَ اجْتَمَعَ رَبِيعَةُ بْنُ الْحَارِثِ وَالْعَبَّاسُ بْنُ عَبْدِ الْمُطَّلِبِ فَقَالاَ وَاللَّهِ لَوْ بَعَثْنَا هَذَيْنِ الْغُلاَمَيْنِ - قَالاَ لِي وَلِلْفَضْلِ بْنِ عَبَّاسٍ - إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَكَلَّمَاهُ فَأَمَّرَهُمَا عَلَى هَذِهِ الصَّدَقَاتِ فَأَدَّيَا مَا يُؤَدِّي النَّاسُ وَأَصَابَا مِمَّا يُصِيبُ النَّاسُ - قَالَ - فَبَيْنَمَا هُمَا فِي ذَلِكَ جَاءَ عَلِيُّ بْنُ أَبِي طَالِبٍ فَوَقَفَ عَلَيْهِمَا فَذَكَرَا لَهُ ذَلِكَ فَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ لاَ تَفْعَلاَ فَوَاللَّهِ مَا هُوَ بِفَاعِلٍ . فَانْتَحَاهُ رَبِيعَةُ بْنُ الْحَارِثِ فَقَالَ وَاللَّهِ مَا تَصْنَعُ هَذَا إِلاَّ نَفَاسَةً مِنْكَ عَلَيْنَا فَوَاللَّهِ لَقَدْ نِلْتَ صِهْرَ رَسُولِ اللَّهِ صلى الله عليه وسلم فَمَا نَفِسْنَاهُ عَلَيْكَ . قَالَ عَلِيٌّ أَرْسِلُوهُمَا . فَانْطَلَقَا وَاضْطَجَعَ عَلِيٌّ - قَالَ - فَلَمَّا صَلَّى رَسُولُ اللَّهِ صلى الله عليه وسلم الظُّهْرَ سَبَقْنَاهُ إِلَى الْحُجْرَةِ فَقُمْنَا عِنْدَهَا حَتَّى جَاءَ فَأَخَذَ بِآذَانِنَا . ثُمَّ قَالَ " أَخْرِجَا مَا تُصَرِّرَانِ " ثُمَّ دَخَلَ وَدَخَلْنَا عَلَيْهِ وَهُوَ يَوْمَئِذٍ عِنْدَ زَيْنَبَ بِنْتِ جَحْشٍ - قَالَ - فَتَوَاكَلْنَا الْكَلاَمَ ثُمَّ تَكَلَّمَ أَحَدُنَا فَقَالَ يَا رَسُولَ اللَّهِ أَنْتَ أَبَرُّ النَّاسِ وَأَوْصَلُ النَّاسِ وَقَدْ بَلَغْنَا النِّكَاحَ فَجِئْنَا لِتُؤَمِّرَنَا عَلَى بَعْضِ هَذِهِ الصَّدَقَاتِ فَنُؤَدِّيَ إِلَيْكَ كَمَا يُؤَدِّي النَّاسُ وَنُصِيبَ كَمَا يُصِيبُونَ - قَالَ - فَسَكَتَ طَوِيلاً حَتَّى أَرَدْنَا أَنْ نُكَلِّمَهُ - قَالَ - وَجَعَلَتْ زَيْنَبُ تُلْمِعُ عَلَيْنَا مِنْ وَرَاءِ الْحِجَابِ أَنْ لاَ تُكَلِّمَاهُ - قَالَ - ثُمَّ قَالَ " إِنَّ الصَّدَقَةَ لاَ تَنْبَغِي لآلِ مُحَمَّدٍ . إِنَّمَا هِيَ أَوْسَاخُ النَّاسِ ادْعُوَا لِي مَحْمِيَةَ - وَكَانَ عَلَى الْخُمُسِ - وَنَوْفَلَ بْنَ الْحَارِثِ بْنِ عَبْدِ الْمُطَّلِبِ " . قَالَ فَجَاءَاهُ فَقَالَ لِمَحْمِيَةَ " أَنْكِحْ هَذَا الْغُلاَمَ ابْنَتَكَ " . لِلْفَضْلِ بْنِ عَبَّاسٍ فَأَنْكَحَهُ وَقَالَ لِنَوْفَلِ بْنِ الْحَارِثِ " أَنْكِحْ هَذَا الْغُلاَمَ ابْنَتَكَ " . لِي فَأَنْكَحَنِي وَقَالَ لِمَحْمِيَةَ " أَصْدِقْ عَنْهُمَا مِنَ الْخُمُسِ كَذَا وَكَذَا " . قَالَ الزُّهْرِيُّ وَلَمْ يُسَمِّهِ لِي .
Abd al-Muttalib b. Rabi'a b. al-Harith reported that Rabi'a b. al-Harith and Abbas b. Abd al-Muttalib gathered together and said:By Allah, if we had sent these two young boys (i. e. I and Fadl b. 'Abbas) to the Messenger of Allah (ﷺ) and they had spoken to him, he would have appointed them (as the collectors) of these sadaqat; and they would (collect them) and pay (to the Holy Prophet) as other people (collectors) paid and would get a share as other people got it. As they were talking about it there came 'Ali b. Abu Talib and stood before them, and they made a mention of it to him. 'Ali b. Abu Talib said: Don't do that; by Allah he (the Holy Prophet) would not do that (would not accept your request). Rabi'a b. Harith turned to him and said: By Allah, you are not doing so but out of jealousy that you nurse against us By Allah, you became the son-in-law of the Messenger of Allah (ﷺ) but we felt no jealousy against you (for this great privilege of yours). 'Ali then said: Send them (if you like). They set out and 'Ali lay on the bed. When the Messenger of Allah (ﷺ) offered the noon prayer. we went ahead of him to his apartment and stood near it till he came out. He took hold of our ears (out of love and affection) and then said: Give out what you have kept in your hearts. He then entered (the apartment) and we also went in and he (the Holy Prophet) was on that day (in the house of) Zainab b. jahsh. We urged each (of us) to speak. Then one of us thus spoke: Messenger of Allah, you are the best of humanity and the best to cement the ties of blood-relations. We have reached the-marriageable age. We have come (to you) so that you may appoint us (as collectors) of these sadaqat. and we would pay you just as thin people (other collectors) pay you, and get our share as others get it. He (the Holy Prophet) kept silence for a long time till we wished that we should speak with him (again), and Zainab pointied to us from behind the curtain not to talk (any more). He (the Holy Prophet) said; It does not become the family of Muhammad (to accept) sadaqat for they are the impurities of people. You call to me Mahmiya (and he was in charge of khums, i. e, of the one-fifth part that goes to the treasury out of the spoils of war), and Naufal b. Harith b. 'Abd al-Muttalib. They both came to him, and he (the Holy Prophet) said to Mahmiya: Marry your daughter to this young man (i. e. Fadl b. 'Abbas), and he married her to him And he said to Naufal b. Harith: Marry your daughter to this young man (i e. 'Abd al-Muttalib b. Rabi'a, the narrator of this hadith) and he married her to me, and he said to Mahmiya: Pay so much mahr on behalf of both of them from this khums Zuhri, however. said: He did not determine (the amount of mahr)

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، وَابْنُ، بَشَّارٍ قَالَ ابْنُ الْمُثَنَّى حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، حَدَّثَنَا شُعْبَةُ، قَالَ سَمِعْتُ قَتَادَةَ، يُحَدِّثُ عَنْ أَبِي نَضْرَةَ، قَالَ كَانَ ابْنُ عَبَّاسٍ يَأْمُرُ بِالْمُتْعَةِ وَكَانَ ابْنُ الزُّبَيْرِ يَنْهَى عَنْهَا قَالَ فَذَكَرْتُ ذَلِكَ لِجَابِرِ بْنِ عَبْدِ اللَّهِ فَقَالَ عَلَى يَدَىَّ دَارَ الْحَدِيثُ تَمَتَّعْنَا مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم . فَلَمَّا قَامَ عُمَرُ قَالَ إِنَّ اللَّهَ كَانَ يُحِلُّ لِرَسُولِهِ مَا شَاءَ بِمَا شَاءَ وَإِنَّ الْقُرْآنَ قَدْ نَزَلَ مَنَازِلَهُ فَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ كَمَا أَمَرَكُمُ اللَّهُ وَأَبِتُّوا نِكَاحَ هَذِهِ النِّسَاءِ فَلَنْ أُوتَى بِرَجُلٍ نَكَحَ امْرَأَةً إِلَى أَجَلٍ إِلاَّ رَجَمْتُهُ بِالْحِجَارَةِ .
(Abu Nadra reported:Ibn 'Abbas commanded the performance of Mut'a putting ihram for 'Umra during the months of Dhul-Hijja and after completing it. then putting on Ihram for Hajj), but Ibn Zubair forbade to do it. I made a mention of it to Jabir b. Abdullih and he said: It is through me that this hadith has been circulated. We entered into the state of Ihram as Tamattu' with the Messenger of Allah (ﷺ). When 'Umar was Installed as Caliph, he said: Verily Allah made permissible for His Messenger (ﷺ) whatever He liked and as Re liked. And (every command) of the Holy Qur'an has been revealed for every occasion. So accomplish Hajj and Umra for Allah as Allah has commanded you; and confirm by (proper conditions) the marriage of those women (with whom you have performed Mut'a). And any person would come to me with a marriage of appointed duration (Mut'a), I would stone him (to death)

وَحَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، حَدَّثَنَا جَرِيرٌ، عَنْ فُضَيْلٍ، عَنْ زُبَيْدٍ، عَنْ إِبْرَاهِيمَ التَّيْمِيِّ، عَنْ أَبِيهِ، قَالَ قَالَ أَبُو ذَرٍّ رضى الله عنه لاَ تَصْلُحُ الْمُتْعَتَانِ إِلاَّ لَنَا خَاصَّةً . يَعْنِي مُتْعَةَ النِّسَاءِ وَمُتْعَةَ الْحَجِّ .
Abu Dharr (Allah be pleased with him) said:Two are the Mut'as which were not permissible but only for us, i. e. temporary marriage with women and Tamattu' in Hajj

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ، وَأَحْمَدُ بْنُ عَبْدَةَ الضَّبِّيُّ، - وَاللَّفْظُ لاِبْنِ أَبِي شَيْبَةَ - قَالَ حَدَّثَنَا وَقَالَ الآخَرَانِ، أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرٍو، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ لَقِيَ نَاسٌ مِنَ الْمُسْلِمِينَ رَجُلاً فِي غُنَيْمَةٍ لَهُ فَقَالَ السَّلاَمُ عَلَيْكُمْ . فَأَخَذُوهُ فَقَتَلُوهُ وَأَخَذُوا تِلْكَ الْغُنَيْمَةَ فَنَزَلَتْ { وَلاَ تَقُولُوا لِمَنْ أَلْقَى إِلَيْكُمُ السَّلَمَ لَسْتَ مُؤْمِنًا} وَقَرَأَهَا ابْنُ عَبَّاسٍ السَّلاَمَ .
Abd Nadra reported:While I was in the company of Jibir, a person came and said: There is difference of opinion amomg Ibn Abbas and Ibn Zubair about two Mut'as (benefits, Tamattul in Hajj and temporary marriage with women), whereupon jibir said: We have been doing this during the lifetime of Allah's Messenger (way peace be upon him), and then 'Umar forbade us to do so, and we never resorted to them

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ الْهَمْدَانِيُّ، حَدَّثَنَا أَبِي وَوَكِيعٌ، وَابْنُ، بِشْرٍ عَنْ إِسْمَاعِيلَ، عَنْ قَيْسٍ، قَالَ سَمِعْتُ عَبْدَ اللَّهِ، يَقُولُ كُنَّا نَغْزُو مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم لَيْسَ لَنَا نِسَاءٌ فَقُلْنَا أَلاَ نَسْتَخْصِي فَنَهَانَا عَنْ ذَلِكَ ثُمَّ رَخَّصَ لَنَا أَنْ نَنْكِحَ الْمَرْأَةَ بِالثَّوْبِ إِلَى أَجَلٍ ثُمَّ قَرَأَ عَبْدُ اللَّهِ { يَا أَيُّهَا الَّذِينَ آمَنُوا لاَ تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللَّهُ لَكُمْ وَلاَ تَعْتَدُوا إِنَّ اللَّهَ لاَ يُحِبُّ الْمُعْتَدِينَ} .
Abdullah (b. Mas'ud) reported:We were on an expedition with Allah's Messenger (ﷺ) and we had no women with us. We said: Should we not have ourselves castrated? He (the Holy Prophet) forbade us to do so He then granted us permission that we should contract temporary marriage for a stipulated period giving her a garment, and 'Abdullah then recited this verse: 'Those who believe do not make unlawful the good things which Allah has made lawful for you, and do not transgress. Allah does not like trangressers" (al-Qur'an, v)

وَحَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، حَدَّثَنَا شُعْبَةُ، عَنْ عَمْرِو بْنِ دِينَارٍ، قَالَ سَمِعْتُ الْحَسَنَ بْنَ مُحَمَّدٍ، يُحَدِّثُ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، وَسَلَمَةَ بْنِ الأَكْوَعِ، قَالاَ خَرَجَ عَلَيْنَا مُنَادِي رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَدْ أَذِنَ لَكُمْ أَنْ تَسْتَمْتِعُوا . يَعْنِي مُتْعَةَ النِّسَاءِ .
Jabir b. 'Abdullah and Salama b. al-Akwa' said:There came to us the proclaimer of Allah's Messenger (ﷺ) and said: Allah's Messenger (ﷺ) has granted you permission to benefit yourselves, i. e. to contract temporary marriage with women

وَحَدَّثَنِي أُمَيَّةُ بْنُ بِسْطَامَ الْعَيْشِيُّ، حَدَّثَنَا يَزِيدُ، - يَعْنِي ابْنَ زُرَيْعٍ - حَدَّثَنَا رَوْحٌ، - يَعْنِي ابْنَ الْقَاسِمِ - عَنْ عَمْرِو بْنِ دِينَارٍ، عَنِ الْحَسَنِ بْنِ مُحَمَّدٍ، عَنْ سَلَمَةَ بْنِ الأَكْوَعِ، وَجَابِرِ بْنِ عَبْدِ اللَّهِ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم أَتَانَا فَأَذِنَ لَنَا فِي الْمُتْعَةِ .
Salama b. al. Akwa' and Jabir b. Abdullah reported:Allah's Messenger (ﷺ) came to us and permitted us to contract temporary marriage
