أَخْبَرَنَا مُحَمَّدُ بْنُ الْعَلَاءِ ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ إِدْرِيسَ ، عَنْ ابْنِ جُرَيْجٍ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، قَالَ :" قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالشُّفْعَةِ فِي كُلِّ شِرْكٍ لَمْ يُقْسَمْ : رَبْعَةٍ أَوْ حَائِطٍ لَا يَحِلُّ لَهُ أَنْ يَبِيعَ حَتَّى يُؤْذِنَ شَرِيكَهُ، فَإِنْ شَاءَ، أَخَذَ، وَإِنْ شَاءَ، تَرَكَ، فَإِنْ بَاعَ وَلَمْ يُؤْذِنْهُ، فَهُوَ أَحَقُّ بِهِ ". قِيلَ لِأَبِي مُحَمَّدٍ : تَقُولُ بِهَذَا؟. قَالَ : نَعَمْ
Muhammad bin Al-Ala’ told us, Abdullah bin Idris told us, on the authority of Ibn Jurayj, on the authority of Abu Al-Zubayr, on the authority of Jabir, who said: “The Messenger of God, may God bless him and grant him peace, grants pre-emption in every polytheism that has not been divided: a quarter or a wall. It is not permissible for him to sell until his partner gives permission. If he wishes, he can take it, and if he wishes, he can leave it. But if he sells and does not give permission, he has more right to it. It was said to Abu Muhammad: Do you say this? He said: Yes.
