Hadith #44879
حَدَّثَنَا إِسْحَاقُ بْنُ عِيسَى، أَنْبَأَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ فَكَانَ لَهُ مَا يَبْلُغُ ثَمَنَ الْعَبْدِ فَإِنَّهُ يُقَوَّمُ قِيمَةَ عَدْلٍ فَيُعْطَى شُرَكَاؤُهُ حَقَّهُمْ وَعَتَقَ عَلَيْهِ الْعَبْدَ وَإِلَّا فَقَدْ أَعْتَقَ مَا أَعْتَقَ.
Ishaq bin Isa told us, Malik told us, on the authority of Nafi’, on the authority of Ibn Umar, may God be pleased with him, that the Messenger of God, may God bless him and grant him peace, said Whoever frees a partner of his in a slave and gets what amounts to the price of the slave, then a just value will be assessed, and his partners will be given their rights and he will be freed. The slave is upon him, otherwise he will free what he has freed.
