Hadith #50597
وَعَن أبي شُرَيحٍ الكعبيِّ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ:
" ثُمَّ أَنْتُمْ يَا خُزَاعَةُ قَدْ قَتَلْتُمْ هَذَا الْقَتِيلَ مِنْ هُذَيْلٍ وَأَنَا وَاللَّهِ عَاقِلُهُ مَنْ قَتَلَ بَعْدَهُ قَتِيلًا فَأَهْلُهُ بَيْنَ خِيرَتَيْنِ: عَن أَحبُّوا قتلوا وَإِن أَحبُّوا أخذا العقلَ ". رَوَاهُ الترمذيُّ وَالشَّافِعِيّ. وَفِي شرح السنَّة بإِسنادِه وَصَرَّحَ: بِأَنَّهُ لَيْسَ فِي الصَّحِيحَيْنِ عَنْ أَبِي شُرَيْح وَقَالَ:
وَأَخْرَجَاهُ مِنْ رِوَايَةِ أَبِي هُرَيْرَةَ يَعْنِي بِمَعْنَاهُ
On the authority of Abu Shurayh al-Kaabi, on the authority of the Messenger of God, may God bless him and grant him peace, he said: “Then you, O Khuza’ah, killed this man from Hudhayl, and I And God is the One who is responsible for whoever kills someone after him, then his family has two choices: they kill if they love, and if they love, they take the mind.” Narrated by Al-Tirmidhi and Al-Shafi’i. And in explaining the Sunnah with its chain of transmission, he stated: It is not in the two Sahih books on the authority of Abu Shurayh, and he said: They took it from the narration of Abu Hurairah, meaning in its meaning
