وَعَنْ عَائِشَةَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «أَيُّمَا امْرَأَةٍ نَكَحَتْ بِغَيْرِ إِذْنِ وَلَيِّهَا فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنْ دَخَلَ بِهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا فَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ من لَا ولي لَهُ» . رَوَاهُ أَحْمَدُ وَالتِّرْمِذِيُّ وَأَبُو دَاوُدَ وَابْنُ مَاجَهْ والدارمي
On the authority of Aisha, the Messenger of God, may God bless him and grant him peace, said: “Any woman who marries without the permission of her guardian, her marriage is invalid.” So her marriage is invalid, so her marriage is invalid. If he consummated the sexual intercourse with her, then she gets the dowry for whatever he made permissible from her private parts. But if they quarrel, then the sultan is the guardian of the one who has no guardian.”
