وَعَن سَعِيدِ بْنِ الْمُسَيَّبِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي الْجَنِينِ يُقْتَلُ فِي بَطْنِ أُمِّهِ بِغُرَّةِ عَبْدٍ أَوْ وَلِيدَةٍ. فَقَالَ الَّذِي قُضِيَ عليهِ: كيفَ أَغْرَمُ مَنْ لَا شَرِبَ وَلَا أَكَلَ وَلَا نَطَقَ وَلَا اسْتَهَلَّ وَمِثْلُ ذَلِكَ يُطَلُّ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِنَّمَا هَذَا مِنْ إِخْوَانِ الْكُهَّانِ» . رَوَاهُ مالكٌ وَالنَّسَائِيّ مُرْسلا
وَرَوَاهُ أَبُو دَاوُدَ عَنْهُ عَنْ أَبِي هُرَيْرَةَ مُتَّصِلا
On the authority of Saeed bin Al-Musayyab: The Messenger of God, may God bless him and grant him peace, decreed that the fetus should be killed in its mother’s womb with the birth of a male slave or female. Then the one against whom the judgment was judged said: How can I be fined if someone does not drink, eat, speak, or engage in eloquence, and someone like that is neglectful? Then the Messenger of God, may God bless him and grant him peace, said He, peace and blessings be upon him, said: “This is one of the brothers of soothsayers.” It was narrated by Malik and Al-Nasa’i in a mursal form, and it was narrated by Abu Dawud on his authority, on the authority of Abu Hurairah, connected.
