وقال المالك: إذا جامع الشريك جارية عامة فلا حد له. والآن يصبح الولد المولود لها قرابة، وعلى الشركاء الآخرين دفع نصيبهم بقيمة الجارية، وتكون الجارية له. هذا هو الترتيب وفقا لنا. قال السيد: إذا أذن إنسان في أن يجامع جاريته فإن ذلك إذا جامعها فعليه ثمن العبد سواء كانت حاملا أو غير حامل، ولا حد، فإذا حملت ثبت نسب الولد منها.
The owner said that if a partner has intercourse with a common slave girl, there is no limit on it. Now, the boy who is born will be related to her, and the other partners will have to pay their share according to the value of the slave girl, and the slave girl will belong to him. This is the order according to us. The master said, "If a person gives permission to have intercourse with his slave girl, that person If he has sexual intercourse with her, he will have to pay the price of the slave whether she is pregnant or not, but there will be no limit. If she becomes pregnant, the parentage of the child will be proved from her.
