Hadith #50204
وَعَن الْمِقْدَام قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ فَمَنْ تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَإِلَيْنَا وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَأَنَا مَوْلَى مَنْ لَا مَوْلَى لَهُ أَرِثُ مَالَهُ وَأَفُكُّ عَانَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ يَرِثُ مَالَهُ وَيَفُكُّ عَانَهُ» . وَفِي رِوَايَةٍ: «وَأَنَا وَارِثُ مَنْ لَا وَارِثَ لَهُ أَعْقِلُ عَنْهُ وَأَرِثُهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ يَعْقِلُ عَنْهُ ويرثه» . رَوَاهُ أَبُو دَاوُد
On the authority of Al-Miqdam, he said: The Messenger of God, may God’s prayers and peace be upon him, said: “I have more right over every believer than himself. So whoever leaves behind a debt or property, then come to us.” And whoever leaves behind wealth, it is his heirs, and I am the guardian of someone who has no guardian. I inherit his wealth and make amends for him, and the maternal uncle is the heir. He who has no heir inherits. his wealth and redeem his burden.” And in a narration: “I am the heir of one who has no heir. I inherit from him and inherit from him, and the maternal uncle is the heir of one who has no heir. He inherits from him and inherits from him.” Narrated by Abu Dawood
