عَن عُمَيْر بن سعيد النخفي قَالَ: سَمِعْتُ عَلِيَّ بْنَ أَبِي طَالِبٍ يَقُولُ: مَا كُنْتُ لِأُقِيمَ عَلَى أَحَدٍ حَدًّا فَيَمُوتَ فَأَجِدَ فِي نَفْسِي مِنْهُ شَيْئًا إِلَّا صَاحِبَ الْخَمْرِ فَإِنَّهُ لَوْ مَاتَ وَدَيْتُهُ وَذَلِكَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمْ يسنه
On the authority of Umair bin Saeed al-Nakhi, who said: I heard Ali bin Abi Talib say: I would not impose punishment on anyone and he dies and I find in myself anything of him except a companion. Alcohol, if he died, its blood money would be paid for, and that is because the Messenger of God, may God bless him and grant him peace, did not enact it.
