الحديث 40. قال يحيى (رضي الله عنه): سمعت مالكا (رضي الله عنه) يقول فيمن فرض عليه صيام شهرين متتابعين في قتل خطأ أو ظهار[1]. وبعد ذلك كان يجد صعوبة في الإفطار، فإن شفي وتمكن من الصيام فأفضل ما سمعت أنه لا يجوز له تأخيره. ويقضي بقية صيامه على ما أتمه من صيام قبله. وكذلك المرأة التي وجب عليها الصيام لقتل غير متعمد، فلا تصوم إذا حاضت في منتصف صومها. لكن إذا نضجت فلا يؤخر الصيام، ويكون بقية الصيام على ما كان قد صامه من قبل. ولا يجوز لمن فرض عليه صيام شهرين متتابعين على حكم الكتاب إلا الوجع والحيض. فلا يجوز لمثل هذا الإنسان أن يفطر بعد بدء الرحلة. كما جاء في القرآن الكريم: "فمن كان منكم مريضاً أو على سفر فليصم يوماً آخر". قال يحيى - رضي الله عنه - قال مالك - رضي الله عنه -: وهذا أحسن ما سمعت لي في هذا الباب.
Tradition 40. Yaya (RA) said, I heard Malik (RA) say about a person on whom fasting for two consecutive months has been made obligatory - for killing by mistake or committing zihar[1]. After that, he had a hard time breaking the fast done If he recovers and is able to fast, then the best of what I have heard (in this regard) is that it is not permissible for him to delay it. He will keep the rest of the fast on the basis of the fast he has completed before. Likewise, a woman on whom fasting has become obligatory due to a manslaughter, should not fast if she menstruates in the middle of her fast. However, if it becomes ripe, then he should not delay in fasting and the rest of the fast will be based on the fast he had previously observed. God's It is not permissible for a person on whom fasting for two consecutive months has been obligatory according to the provisions of the Book, except for pain and menstruation. It is not permissible for such a person to break his fast after starting the journey. as It is stated in the Holy Qur'an, "Whoever among you is sick or on a journey, he should fast on another day." Yahya (RA) said - Malik (RA) said: This is the best for me among what I have heard in this regard.
