وَعَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ: أَنَّ امْرَأَتَيْنِ كَانَتَا ضَرَّتَيْنِ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ أَوْ عَمُودِ فُسْطَاطٍ فَأَلْقَتْ جَنِينَهَا فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الجَنينِ غُرَّةً: عبْداً أَوْ أَمَةٌ وَجَعَلَهُ عَلَى عَصَبَةِ الْمَرْأَةِ هَذِهِ رِوَايَةُ التِّرْمِذِيِّ وَفِي رِوَايَةِ مُسْلِمٍ: قَالَ: ضَرَبَتِ امْرَأَةٌ ضَرَّتَهَا بِعَمُودِ فُسْطَاطٍ وَهِيَ حُبْلَى فَقَتَلَتْهَا قَالَ: وَإِحْدَاهُمَا لِحْيَانَيَّةٌ قَالَ: فَجَعَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ دِيَة الْمَقْتُول عَلَى عَصَبَةِ الْقَاتِلَةِ وَغُرَّةً لِمَا فِي بَطْنِهَا
On the authority of Al-Mughirah bin Shu’bah: Two women were co-wives, and one of them threw a stone or a tent at the other, causing her to lose her fetus. So the Messenger of God, may God’s prayers and peace be upon him, judged whether the fetus was a slave or a female slave, and placed him on the woman’s side. This is the narration of Al-Tirmidhi. And in the narration of Muslim: He said: A woman was hit by a tent pole while she was pregnant and killed her. He said: One of them was Hayaniyah. He said: So the Messenger of God, may God bless him and grant him peace, placed the blood money for the murdered person on the killer’s neck and a portion for what was in her womb.
