Hadith #50116
وَعَنْهُ قَالَ: قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالشُّفْعَةِ فِي كُلِّ شَرِكَةٍ لَمْ تُقْسَمْ رَبْعَةٍ أَوْ حَائِطٍ: «لَا يَحِلُّ لَهُ أَن يَبِيع حَتَّى يُؤذن شَرِيكه فَإِن شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ فَإِذَا بَاعَ وَلَمْ يُؤْذِنْهُ فَهُوَ أَحَقُّ بِهِ» . رَوَاهُ مُسْلِمٌ
On his authority, he said: The Messenger of God, may God bless him and grant him peace, ruled that there should be pre-emption in every company that did not divide a quarter or a wall: “It is not permissible for him to sell Until his partner gives permission, then if he wants, he can take it, and if he wants, he can leave it. But if he sells and does not give permission, then he has more right to it.” Narrated by Muslim
