وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قضى أَن كل مستحلق استحلق بَعْدَ أَبِيهِ الَّذِي يُدْعَى لَهُ ادَّعَاهُ وَرَثَتُهُ فَقَضَى أَنَّ كُلَّ مَنْ كَانَ مِنْ أَمَةٍ يملكهَا يَوْم أَصَابَهَا فقد لحق بِمن استحلقه وَلَيْسَ لَهُ مِمَّا قُسِمَ قَبْلَهُ مِنَ الْمِيرَاثِ شَيْءٌ وَمَا أَدْرَكَ مِنْ مِيرَاثٍ لَمْ يُقْسَمْ فَلَهُ نَصِيبُهُ وَلَا يَلْحَقُ إِذَا كَانَ أَبُوهُ الَّذِي يُدْعَى لَهُ أَنْكَرَهُ فَإِنْ كَانَ مِنْ أمَةٍ لم يَملِكْها أَو من حُرَّةٍ عَاهَرَ بِهَا فَإِنَّهُ لَا يَلْحَقُ بِهِ وَلَا يَرِثُ وَإِنْ كَانَ الَّذِي يُدْعَى لَهُ هُوَ الَّذِي ادَّعَاهُ فَهُوَ وَلَدُ زِنْيَةٍ مِنْ حُرَّةٍ كَانَ أَوْ أَمَةٍ. رَوَاهُ أَبُو دَاوُدَ
On the authority of Amr bin Shuaib, on the authority of his father, on the authority of his grandfather, that the Prophet, may God’s prayers and peace be upon him, ruled that every mustahil who became a slave after his father, for whom he is claimed, is claimed by his heirs. He ruled that whoever belonged to a female slave who owned it on the day he acquired it has joined the one who claimed it, and he does not have anything of the inheritance that was divided before him. And whatever inheritance he attains that has not been divided, he has his share and is not entitled to it if his father, to whom it is claimed, denies it. If he is from a female slave whom he did not own, or from a free woman. He committed adultery with her, then he will not join her and will not inherit. And if the one to whom it is claimed is the one he claimed, then he is the child of an adulteress from a free woman, whether she or not. A nation. Narrated by Abu Dawood
