حَدَّثَنَا قُتَيْبَةُ، وَأَحْمَدُ بْنُ مَنِيعٍ، وَأَبُو عَمَّارٍ وَغَيْرُ وَاحِدٍ قَالُوا حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، أَنَّ عُمَرَ، كَانَ يَقُولُ الدِّيَةُ عَلَى الْعَاقِلَةِ وَلاَ تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا شَيْئًا . حَتَّى أَخْبَرَهُ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلاَبِيُّ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم كَتَبَ إِلَيْهِ
" أَنْ وَرِّثِ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ .
Qutaybah, Ahmad bin Mani’, Abu Ammar and more than one person narrated to us. They said: Sufyan bin Uyaynah narrated to us, on the authority of Al-Zuhri, on the authority of Sa’id bin Al-Musayyab, that Omar used to say that the blood-money is due on the free woman, and the woman does not inherit anything from her husband’s blood-money. Until Al-Dahhak ibn Al-Dahhak told him Sufyan Al-Kalabi reported that the Messenger of God, may God’s prayers and peace be upon him, wrote to him “to inherit the wife of Ashim Al-Dhababi from her husband’s blood money.” Abu said. Jesus, this is a good and authentic hadith. This is acted upon according to the people of knowledge.
