Hadith #27572
Qutaibah narrated to us, Abu Awanah narrated to us, on the authority of Qatada, on the authority of Al-Hasan, on the authority of Samurah, he said: The Messenger of God, may God’s prayers and peace be upon him, said: “Whoever kills his servant We killed him, and whoever harms his servant, We kill him.” Abu Issa said, “This is a hasan ghareeb hadith, and some of the scholars among the followers have said Among them is Ibrahim Al-Nakha'i and some of the scholars, including Al-Hasan Al-Basri and Ata' bin Abi Rabah, said: There is no difference between a free man and a slave. Retaliation for the soul or for anything other than the soul. This is the statement of Ahmad and Ishaq. Some of them said: If he kills his servant, he will not be killed for it. If a slave kills another, he will be killed for him. This is the view of Sufyan Al-Thawri and the people of Kufa.
