حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ إِسْحَاق بْنِ سُوَيْدٍ ، عَنْ الْعَلَاءِ بْنِ زِيَادٍ : أَنَّ رَجُلًا سَأَلَ عُمَرَ بْنَ الْخَطَّابِ ، فَقَالَ : " إِنَّ وَارِثِي كَلَالَةٌ، فَأُوصِي بِالنِّصْفِ؟ قَالَ : لَا، قَالَ : فَالثُّلُثِ؟ قَالَ : لَا، قَالَ : فَالرُّبُع؟ قَالَ : لَا، قَالَ : فَالْخُمُس؟ قَالَ : لَا، حَتَّى صَارَ إِلَى الْعُشْرِ، فَقَالَ :أَوْصِ بِالْعُشْرِ "
Suleiman bin Harb told us, Hammad bin Zaid told us, on the authority of Ishaq bin Suwayd, on the authority of Al-Alaa bin Ziyad: That a man asked Omar bin Al-Khattab, He said: “My heir is a slave, so should I bequeath half?” He said: No. He said: A third? He said: No. He said: A quarter? He said: No. He said: A fifth? He said: No, until he came to the tithe, and said: “Command the tithe.”
