Sunan ad-Darimi # 12/2191
أَخْبَرَنَا خَالِدُ بْنُ مَخْلَدٍ ، حَدَّثَنَا مَالِكٌ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ : أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ :" مُرْهُ أَنْ يُرَاجِعَهَا وَيُمْسِكَهَا حَتَّى تَطْهُرَ، ثُمَّ تَحِيضُ، ثُمَّ تَطْهُرُ، ثُمَّ إِنْ شَاءَ، أَمْسَكَ، وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ "
Khalid bin Mukhlid told us, Malik told us, on the authority of Nafi’, on the authority of Ibn Umar: He divorced his wife while she was menstruating, so Umar mentioned that. To the Prophet, may God bless him and grant him peace, and he said: “Tell him to take her back and keep her until she is pure, then she will menstruate, then she will be pure, then if he wishes, he may keep her. And if If he wishes, he may be divorced before he has been touched, and that is the waiting period for which God has commanded that women be divorced.”

Sunan ad-Darimi # 12/2192
أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى ، أَخْبَرَنَا سُفْيَانُ ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ ، قَالَ : سَمِعْتُ سَالِمًا يَذْكُرُ، عَنِ ابْنِ عُمَرَ : أَنَّ عُمَرَ، قَالَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حِينَ طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ، فَقَالَ :" مُرْهُ فَلْيُرَاجِعْهَا، ثُمَّ لِيُطَلِّقْهَا وَهِيَ طَاهِرَةٌ ".
قَالَ أَبُو مُحَمَّدٍ : رَوَاهُ ابْنُ الْمُبَارَكِ ، وَوَكِيعُ : " أَوْ حَامِلٌ "
Ubayd Allah ibn Musa informed us, Sufyan informed us, on the authority of Muhammad ibn Abdul Rahman, he said: I heard Salim mention, on the authority of Ibn Umar: that Umar, He said to the Prophet, may God bless him and grant him peace, when Ibn Umar divorced his wife, and he said: “Tell him to take her back, then to divorce her while she is Pure.” Abu Muhammad said: Narrated by Ibn Al-Mubarak, and Waki’: “Or pregnant.”

حَدَّثَنَا إِسْمَاعِيل بْنُ خَلِيلٍ ، وَإِسْمَاعِيل بْنُ أَبَانَ ، قَالَا : حَدَّثَنَا يَحْيَى بْنُ أَبِي زَائِدَةَ ، عَنْ صَالِحِ بْنِ صَالِحٍ ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، عَنْ ابْنِ عَبَّاسٍ ، عَنْ عُمَرَ ، قَالَ :" طَلَّقَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَفْصَةَ ثُمَّ رَاجَعَهَا "
Ismail bin Khalil and Ismail bin Aban narrated to us, saying: Yahya bin Abi Zaida narrated to us, on the authority of Salih bin Salih, on the authority of Salama Ibn Kuhayl, on the authority of Saeed Ibn Jubayr, on the authority of Ibn Abbas, on the authority of Omar, who said: “The Messenger of God, may God bless him and grant him peace, divorced Hafsa and then took her back.”

أَخْبَرَنَا سَعِيدُ بْنُ سُلَيْمَانَ ، عَنْ هُشَيْمٍ ، عَنْ حُمَيْدٍ ، عَنْ أَنَسٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ" طَلَّقَ حَفْصَةَ ثُمَّ رَاجَعَهَا ".
قَالَ أَبُو مُحَمَّدٍ : كَانَّ عَلِيَّ بْنَ الْمَدِينِيِّ أَنْكَرَ هَذَا الْحَدِيثَ، وَقَالَ : لَيْسَ عِنْدَنَا هَذَا الْحَدِيثُ بِالْبَصْرَةِ ، عَنْ حُمَيْدٍ

أَخْبَرَنَا الْحَكَمُ بْنُ مُوسَى ، حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ ، عَنْ سُلَيْمَانَ بْنِ دَاوُدَ ، حَدَّثَنِي الزُّهْرِيُّ ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، قَالَ الْحَكَمُ ، قَالَ لِي يَحْيَى بْنُ حَمْزَةَ : أَفْصِلُ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَى أَهْلِ الْيَمَنِ :" أَنْ لَا يَمَسَّ الْقُرْآنَ إِلَّا طَاهِرٌ، وَلَا طَلَاقَ قَبْلَ إِمْلَاكٍ، وَلَا عَتَاقَ حَتَّى يَبْتَاعَ ".
سُئِلَ أَبُو مُحَمَّدٍ ، عَنْ سُلَيْمَانُ، قَالَ : أَحْسَبُهُ كَاتِبًا مِنْ كُتَّابِ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ
Al-Hakam bin Musa told us, Yahya bin Hamza told us, on the authority of Sulayman bin Dawud, Al-Zuhri told me, on the authority of Abu Bakr bin Muhammad bin Amr ibn Hazm, on the authority of his father, on the authority of his grandfather, Al-Hakam said, Yahya ibn Hamza said to me: I will specify that the Messenger of God, may God bless him and grant him peace He wrote To the people of Yemen: “No one should touch the Qur’an except one who is pure, and there should be no divorce before possession, and no emancipation until it is bought.” Abu Muhammad was asked about Suleiman, and he said: I consider him to be one of the writers of Omar bin Abdul Aziz.

أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ ، حَدَّثَنَا ابْنُ عُيَيْنَةَ ، عَنْ الزُّهْرِيِّ ، قَالَ : سَمِعْتُ عُرْوَةَ بْنَ الزُّبَيْرِ ، عَنْ عَائِشَةَ ، قَالَتْ : جَاءَتِ امْرَأَةُ رِفَاعَةَ الْقُرَظِيِّ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَعِنْدَهُ أَبُو بَكْرٍ، وَخَالِدُ بْنُ سَعِيدِ بْنِ الْعَاصِ عَلَى الْبَابِ يَنْتَظِرُ أَنْ يُؤْذَنَ لَهُ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَتْ : يَا رَسُولَ اللَّهِ، إِنِّي كُنْتُ عِنْدَ رِفَاعَةَ فَطَلَّقَنِي فَبَتَّ طَلَاقِي، قَالَ :" أَتُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ؟ لَا، حَتَّى يَذُوقَ عُسَيْلَتَكِ، وَتَذُوقِي عُسَيْلَتَهُ ".
فَنَادَى خَالِدُ بْنُ سَعِيدٍ أَبَا بَكْرٍ : أَلَا تَرَى مَا تَجْهَرُ بِهِ هَذِهِ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؟
Muhammad bin Yusuf told us, Ibn Uyaynah told us, on the authority of Al-Zuhri, he said: I heard Urwa bin Al-Zubayr, on the authority of Aisha, she said: She came The wife of Rifa'ah Al-Qurdi went to the Messenger of God, may God bless him and grant him peace, and with him was Abu Bakr, and Khaled bin Saeed bin Al-Aas was at the door. He was waiting for the Messenger of God, may God bless him and grant him peace, to be called to prayer. She said: O Messenger of God, I was with Rifa’ah and he divorced me, so my divorce was finalized. He said: “Do you want to return to Rifa’ah? No, so that he may taste your honey, and you may taste his honey.” Then Khaled bin Saeed called Abu Bakr: Don’t you see what this woman is saying openly to the Messenger of God, may God bless him and grant him peace?

حَدَّثَنَا فَرْوَةُ بْنُ أَبِي الْمَغْرَاءِ ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ ، عَنْ هِشَامِ بْنِ عُرْوَة ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَتْ : طَلَّقَ رِفَاعَة رَجُلٌ مِنْ بَنِي قُرَيْظَةَ امْرَأَتَهُ فَتَزَوَّجَهَا عَبْدُ الرَّحْمَنِ بْنُ الزُّبَيْرِ، فَدَخَلَتْ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَتْ : يَا رَسُولَ اللَّهِ، وَاللَّهِ إِنْ مَعَهُ إِلَّا مِثْلُ هُدْبَتِي هَذِهِ، فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" لَعَلَّكِ تُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ؟ لَا، حَتَّى يَذُوقَ عُسَيْلَتَكِ أَوْ قَالَ تَذُوقِي عُسَيْلَتَهُ "
Farwah bin Abi Al-Mughra’ narrated to us, Ali bin Mushar narrated to us, on the authority of Hisham bin Urwa, on the authority of his father, on the authority of Aisha, she said: He divorced Rifa'ah, a man from Banu Qurayza, married his wife to Abd al-Rahman bin al-Zubayr, and she went to the Messenger of God, may God bless him and grant him peace. She said: O Messenger of God, by God, he only has a gift like this of mine. So the Messenger of God, may God bless him and grant him peace, said to her: “Perhaps you want To return to Rifa'ah, so that he may taste your sweetness, or he said, taste his sweetness?

أَخْبَرَنَا يَعْلَى ، حَدَّثَنَا إِسْمَاعِيل بْنُ أَبِي خَالِدٍ ، عَنْ الشَّعْبِيِّ ، عَنْ مَسْرُوقٍ ، قَالَ : سَأَلْتُ عَائِشَةَ عَنِ الْخِيَرَةِ، فَقَالَتْ :" قَدْ خَيَّرَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَفَكَانَ طَلَاقًا؟ "
Ya’la told us, Ismail bin Abi Khaled told us, on the authority of Al-Sha’bi, on the authority of Masruq, he said: I asked Aisha about good things, and she said: “It may be good.” The Messenger of God, may God bless him and grant him peace, gave us a choice about divorce?

حَدَّثَنَا مُحَمَّدُ بْنُ الْفَضْلِ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ أَيُّوبَ ، عَنْ أَبِي قِلَابَةَ ، عَنْ أَبِي أَسْمَاءَ ، عَنْ ثَوْبَانَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" أَيُّمَا امْرَأَةٍ سَأَلَتْ زَوْجَهَا الطَّلَاقَ مِنْ غَيْرِ بَأْسٍ، فَحَرَامٌ عَلَيْهَا رَائِحَةُ الْجَنَّةِ "
Muhammad bin Al-Fadl told us, Hammad bin Zaid told us, on the authority of Ayyub, on the authority of Abu Qalaba, on the authority of Abu Asma, on the authority of Thawban, he said: He said: The Messenger of God, may God bless him and grant him peace: “Any woman who asks her husband for a divorce without any reason, the scent of Paradise will be forbidden to her.”

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أَخْبَرَنَا يَحْيَى هُوَ ابْنُ سَعِيدٍ ، أَنَّ عَمْرَةَ أَخْبَرَتْهُ، أَنَّ حَبِيبَةَ بِنْتَ سَهْلٍ تَزَوَّجَهَا ثَابِتُ بْنُ قَيْسِ بْنِ شَمَّاسٍ، فَذَكَرَتْ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ هَمَّ أَنْ يَتَزَوَّجَهَا.
وَكَانَتْ جَارَةً لَهُ، وَأَنَّ ثَابِتًا ضَرَبَهَا، فَأَصْبَحَتْ عَلَى بَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْغَلَسِ، وَأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ، فَرَأَى إِنْسَانًا فَقَالَ : " مَنْ هَذَا؟ " قَالَتْ : أَنَا حَبِيبَةُ بِنْتُ سَهْلٍ ، فَقَالَ : " مَا شَأْنُكِ؟ "، قَالَتْ : لَا أَنَا وَلَا ثَابِتٌ، فَأَتَى ثَابِتٌ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ لَهُ رَسُولُ اللَّهِ :" خُذْ مِنْهَا وَخَلِّ سَبِيلَهَا "، فَقَالَتْ : يَا رَسُولَ اللَّهِ، عِنْدِي كُلُّ شَيْءٍ أَعْطَانِيهِ فَأَخَذَ مِنْهَا، وَقَعَدَتْ عِنْدَ أَهْلِهَا
Yazid bin Harun told us. Yahya bin Sa’id told us that Amra told him that he had married Habiba bint Sahl. She said: I am Habiba bint Sahl. He said: What is the matter with you? She said: Neither I nor Thabit. So Thabit came to the Messenger of God. May God’s prayers and peace be upon him. Then the Messenger of God said to him: “Take her and let her go.” She said: O Messenger of God, I have everything he gave me. So he took it. From her, and she stayed with her family

حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، حَدَّثَنَا جَرِيرُ بْنُ حَازِمٍ ، عَنْ الزُّبَيْرِ بْنِ سَعِيدٍ رَجُلٍ مِنْ بَنِي عَبْدِ الْمُطَّلِبِ، قَالَ : بَلَغَنِي حَدِيثٌ عَنْ عَبْدِ اللَّهِ بْنِ عَلِيِّ بْنِ يَزِيدَ بْنِ رُكَانَةَ ، وَهُوَ فِي قَرْيَةٍ لَهُ، فَأَتَيْتُهُ، فَسَأَلْتُهُ، فَقَالَ : حَدَّثَنِي أَبِي ، عَنْ جَدِّي أَنَّهُ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ، فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَ ذَلِكَ لَهُ، فَقَالَ :" مَا أَرَدْتَ؟ "، فَقَالَ : وَاحِدَةً، قَالَ : " آللَّهِ؟ " قَالَ : آللَّهِ، قَالَ : " هُوَ مَا نَوَيْتَ "
Suleiman bin Harb told us, Jarir bin Hazim told us, on the authority of Al-Zubayr bin Saeed, a man from Banu Abdul Muttalib, who said: I was informed of a hadith on the authority of Abdullah bin Ali bin Yazid bin Rukana, and he was in a village of his, so I came to him and asked him, and he said: My father told me, on the authority of my grandfather that He divorced His wife at all, so he came to the Prophet, may God bless him and grant him peace, and mentioned that to him. He said: “What did you want?” He said: “One.” He said: “By God?” He said: By God, he said: “It is what you intended.”

حَدَّثَنَا زَكَرِيَّا بْنُ عَدِيٍّ ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ إِدْرِيسَ ، عَنْ مُحَمَّدِ بْنِ إِسْحَاق ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ سَلَمَةَ بْنِ صَخْرٍ الْبَيَاضِيِّ ، قَالَ : كُنْتُ امْرَأً أُصِيبُ مِنَ النِّسَاءِ مَا لَا يُصِيبُ غَيْرِي، فَلَمَّا دَخَلَ شَهْرُ رَمَضَانَ، خِفْتُ أَنْ أُصِيبَ فِي لَيْلِي شَيْئًا، فَيَتَتَابَعَ بِي ذَلِكَ إِلَى أَنْ أُصْبِحَ، قَالَ : فَتَظَاهَرْتُ إِلَى أَنْ يَنْسَلِخَ، فَبَيْنَا هِيَ لَيْلَةً تَخْدُمُنِي، إِذْ تَكَشَّفَ لِي مِنْهَا شَيْءٌ، فَمَا لَبِثْتُ أَنْ نَزَوْتُ عَلَيْهَا فَلَمَّا أَصْبَحْتُ، خَرَجْتُ إِلَى قَوْمِي فَأَخْبَرْتُهُمْ، وَقُلْتُ : امْشُوا مَعِي إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالُوا : لَا وَاللَّهِ، لَا نَمْشِي مَعَكَ، مَا نَأْمَنُ أَنْ يَنْزِلَ فِيكَ الْقُرْآنُ، أَوْ أَنْ يَكُونَ فِيكَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَقَالَةٌ يَلْزَمُنَا عَارُهَا، وَلَنُسْلِمَنَّكَ بِجَرِيرَتِكَ.
فَانْطَلَقْتُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَصَصْتُ عَلَيْهِ خَبَرِي، فَقَالَ : " يَا سَلَمَةُ،أَنْتَ بِذَاكَ؟ " قُلْتُ : أَنَا بِذَاكَ، قَالَ : " يَا سَلَمَةُ، أَنْتَ بِذَاكَ؟ " قُلْتُ : أَنَا بِذَاكَ، قَالَ : " يَا سَلَمَةُ، أَنْتَ بِذَاكَ؟ " قُلْتُ : أَنَا بِذَاكَ، وَهَأَنَا صَابِرٌ نَفْسِي، فَاحْكُمْ فِيَّ مَا أَرَاكَ اللَّهُ، قَالَ : " فَأَعْتِقْ رَقَبَةً "، قَالَ : فَضَرَبْتُ صَفْحَةَ رَقَبَتِي، فَقُلْتُ : وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَصْبَحْتُ أَمْلِكُ رَقَبَةً غَيْرَهَا، قَالَ : " فَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ "، قُلْتُ : وَهَلْ أَصَابَنِي الَّذِي أَصَابَنِي إِلَّا فِي الصِّيَامِ؟ قَالَ : " فَأَطْعِمْ وَسْقًا مِنْ تَمْرٍ سِتِّينَ مِسْكِينًا "، فَقُلْتُ : وَالَّذِي بَعَثَكَ بِالْحَقِّ، لَقَدْ بِتْنَا لَيْلَتَنَا وَحْشَى، مَالَنَا مِنَ الطَّعَام، قَالَ : " فَانْطَلِقْ إِلَى صَاحِبِ صَدَقَةِ بَنِي زُرَيْقٍ فَلْيَدْفَعْهَا إِلَيْكَ، وَأَطْعِمْ سِتِّينَ مِسْكِينًا وَسْقًا مِنْ تَمْرٍ، وَكُلْ بَقِيَّتَهُ أَنْتَ وَعِيَالُكَ "، قَالَ : فَأَتَيْتُ قَوْمِي، فَقُلْتُ : وَجَدْتُ عِنْدَكُمُ الضِّيقَ وَسُوءَ الرَّأْيِ، وَوَجَدْتُ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ السَّعَةَ وَحُسْنَ الرَّأْيِ، وَقَدْ أَمَرَ لِي بِصَدَقَتِكُمْ
Zakaria bin Adi told us, Abdullah bin Idris told us, on the authority of Muhammad bin Ishaq, on the authority of Muhammad bin Amr, on the authority of Suleiman bin Yasar, On the authority of Salamah bin Sakhr Al-Bayyadi, he said: I was a man who was affected by women that no one else was affected by, so when the month of Ramadan began, I was afraid that he would be affected. Something happened in my night, and this would continue with me until the morning. He said: So I pretended until it had passed. While it was a night serving me, it was revealed to me. I had no time for her, and when I woke up in the morning, I went out to my people and told them, and said: Go with me to the Messenger of God. May God bless him and grant him peace. They said: No, by God, we will not walk with you. We do not feel confident that the Qur’an will be revealed to you, or that the Messenger of God, may God bless him and grant him peace, will be among you. May God bless him and grant him peace, this is an article whose shame is binding on us, and we will spare you for your crime. So I went to the Messenger of God, may God bless him, He greeted me, so I told him my news. He said: “O Salama, are you with that?” I said: I am with that. He said: “O Salama, are you with that?” I said: I am with that. أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ ، حَدَّثَنَا سُفْيَانُ ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ ، عَنْ الشَّعْبِيِّ ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ :" أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا فَلَمْ يَجْعَلْ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَفَقَةً وَلَا سُكْنَى ".
قَالَ سَلَمَةُ : فَذَكَرْتُ ذَلِكَ لِإِبْرَاهِيمَ، فَقَالَ : قَالَ عُمَرُ بْنُ الْخَطَّابِ : لَا نَدَعُ كِتَابَ رَبِّنَا وَسُنَّةَ نَبِيِّهِ بِقَوْلِ امْرَأَةٍ، فَجَعَلَ لَهَا السُّكْنَى وَالنَّفَقَةَ

قَالَ أَبُو مُحَمَّدٍ : لَا أَرَى السُّكْنَى وَالنَّفَقَةَ لِلْمُطَلَّقَةِ

وَقَالَ أَبُو سَلَمَةَ : إِذَا وَضَعَتْ، فَقَدْ حَلَّتْ، فَتَرَاجَعَا فِي ذَلِكَ بَيْنَهُمَا، فَقَالَ أَبُو هُرَيْرَةَ : أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ، فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ فَسَأَلَهَا، فَذَكَرَتْ أُمُّ سَلَمَةَ ، " أَنَّ سُبَيْعَةَ بِنْتَ الْحَارِثِ الْأَسْلَمِيَّةَ مَاتَ عَنْهَا زَوْجُهَا، فَنَفِسَتْ بَعْدَهُ بِلَيَالٍ وَأَنَّ رَجُلًا مِنْ بَنِي عَبْدِ الدَّارِ يُكْنَى أَبَا السَّنَابِلِ خَطَبَهَا، وَأَخْبَرَهَا أَنَّهَا قَدْ حَلَّتْ فَأَرَادَتْ أَنْ تَتَزَوَّجَ غَيْرَهُ، فَقَالَ لَهَا أَبُو السَّنَابِلِ : فَإِنَّكِ لَمْ تَحِلِّينَ، فَذَكَرَتْ سُبَيْعَةُ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَفَأَمَرَهَا أَنْ تَتَزَوَّجَ "

Abu Al-Sanabel said to her: You are not lawful, so she mentioned Subayah That is for the Messenger of God, may God bless him and grant him peace, so he ordered her to get married.”

أَخْبَرَنَا هَاشِمُ بْنُ الْقَاسِمِ ، حَدَّثَنَا شُعْبَةُ ، عَنْ حُمَيْدِ بْنِ نَافِعٍ ، قَالَ : سَمِعْتُ زَيْنَبَ بِنْتَ أَبِي سَلَمَةَ تُحَدِّثُ، عَنْ أُمِّ حَبِيبَةَ بِنْتِ أَبِي سُفْيَانَ : أَنَّ أَخًا لَهَا مَاتَ أَوْ حَمِيمًا لَهَا فَعَمَدَتْ إِلَى صُفْرَةٍ فَجَعَلَتْ تَمْسَحُ يَدَيْهَا، وَقَالَتْ : إِنَّمَا أَفْعَلُ هَذَا لِأَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تَحُدَّ فَوْقَ ثَلَاثٍ إِلَّا عَلَى زَوْجِهَا، فَإِنَّهَا تَحُدُّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا ".
أَخْبَرَنَا هَاشِمُ بْنُ الْقَاسِمِ ، أَخْبَرَنَا شُعْبَةُ ، عَنْ حُمَيْدِ بْنِ نَافِعٍ ، قَالَ : سَمِعْتُ زَيْنَبَ بِنْتَ أُمِّ سَلَمَةَ تُحَدِّثُ عَنْ أُمِّهَا أَوْ امْرَأَةٍ مِنْ أَزْوَاجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، نَحْوَهُ

أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ عَبْدِ الْمَجِيدِ ، حَدَّثَنَا مَالِكٌ ، عَنْ سَعْدِ بْنِ إِسْحَاق بْنِ كَعْبِ بْنِ عُجْرَةَ ، عَنْ عَمَّتِهِ زَيْنَبَ بِنْتِ كَعْبِ بْنِ عُجْرَةَ : أَنَّ الْفُرَيْعَةَ بِنْتَ مَالِكٍ أَخْبَرَتْهَا أَنَّهَا سَأَلَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَأْذَنَ لَهَا أَنْ تَرْجِعَ إِلَى أَهْلِهَا، فَإِنَّ زَوْجِي قَدْ خَرَجَ فِي طَلَبِ أَعْبُدٍ لَهُ أَبَقُوا، فَأَدْرَكَهُمْ حَتَّى إِذَا كَانَ بِطَرَفِ الْقَدُومِ، قَتَلُوهُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" امْكُثِي فِي بَيْتِكِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ "، فَقُلْتُ : إِنَّهُ لَمْ يَدَعْنِي فِي بَيْتٍ أَمْلِكُهُ، وَلَا نَفَقَةٍ، فَقَالَ : " امْكُثِي حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ "، فَاعْتَدَّتْ فِيهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا، قَالَتْ : فَلَمَّا كَانَ عُثْمَانُ : أَرْسَلَ إِلَيَّ فَسَأَلَنِي عَنْ ذَلِكَ فَأَخْبَرْتُهُ، فَاتَّبَعَ ذَلِكَ وَقَضَى بِهِ

أَخْبَرَنَا أَبُو عَاصِمٍ ، عَنْ ابْنِ جُرَيْجٍ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، قَالَ : طُلِّقَتْ خَالَتِي فَأَرَادَتْ أَنْ تَجُدَّ نَخْلًا لَهَا، فَقَالَ لَهَا رَجُلٌ : لَيْسَ لَكِ أَنْ تَخْرُجِين، قَالَتْ : فَأَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرْتُ ذَلِكَ لَهُ، فَقَالَ :" اخْرُجِي فَجُدِّي نَخْلَكِ، فَلَعَلَّكِ أَنْ تَصَدَّقِي أَوْ تَصْنَعِي مَعْرُوفًا "

أَخْبَرَنَا سَهْلُ بْنُ حَمَّادٍ ، حَدَّثَنَا شُعْبَةُ ، عَنْ الْحَكَمِ ، عَنْ إِبْرَاهِيمَ ، عَنْ الْأَسْوَدِ ، عَنْ عَائِشَةَ : أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ بَرِيرَةَ ، فَأَرَادَ مَوَالِيهَا أَنْ يَشْتَرِطُوا وَلَاءَهَا، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ :" اشْتَرِيهَا، فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ "، فَاشْتَرَتْهَا فَأَعْتَقَتْهَا، وَخَيَّرَهَا مِنْ زَوْجِهَا وَكَانَ حُرًّا وَأَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أُتِيَ بِلَحْمٍ، فَقَالَ : " مِنْ أَيْنَ هَذَا؟ " قِيلَ : تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ ، فَقَالَ : " هُوَ لَهَا صَدَقَةٌ، وَلَنَا هَدِيَّةٌ "
Sahl bin Hammad told us, Shu`bah told us, on the authority of Al-Hakam, on the authority of Ibrahim, on the authority of Al-Aswad, on the authority of Aisha: that she wanted to You buy Bareerah, and her masters wanted to make a condition of her loyalty, so she mentioned that to the Messenger of God, may God bless him and grant him peace, and he said: “Buy her. It is only Loyalty goes to the one who freed her.” So she bought her and freed her, and he gave her the choice of her husband, and he was free, and the Prophet, may God’s prayers and peace be upon him, was brought with meat. He said: “Where is this from?” It was said: You give it in charity to Barira, and he said: “It is charity for her, and for us it is a gift.”

أَخْبَرَنَا إِسْمَاعِيل بْنُ خَلِيلٍ ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ ، حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَتْ : دَخَلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَيَّ فَقَرَّبْتُ إِلَيْهِ طَعَامًا لَيْسَ فِيهِ لَحْمٌ، فَقَالَ :" أَلَمْ أَرَ لَكُمْ قِدْرًا مَنْصُوبَةً؟ " قُلْتُ : يَا رَسُولَ اللَّهِ، هَذَا لَحْمٌ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ ، فَأَهْدَتْ لَنَا، قَالَ : " هُوَ عَلَيْهَا صَدَقَةٌ، وَهُوَ لَنَا مِنْهَا هَدِيَّةٌ "، وَكَانَ لَهَا زَوْجٌ، فَلَمَّا عُتِقَتْ، خُيِّرَتْ

أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ الضَّحَّاكِ ، عَنْ الْمُغِيرَةِ بْنِ عَبْدِ الرَّحْمَنِ الْمَخْزُومِيِّ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ : " أَنَّ بَرِيرَةَ حِينَ أَعْتَقَتْهَا عَائِشَةُ ، كَانَ زَوْجُهَا عَبْدًا،فَجَعَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَحُضُّهَا عَلَيْهِ، فَجَعَلَتْ تَقُولُ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَلَيْسَ لِي أَنْ أُفَارِقَهُ؟ قَالَ : " بَلَى "، قَالَتْ : فَقَدْ فَارَقْتُهُ
Abd al-Rahman ibn al-Dahhak informed us, on the authority of al-Mughirah ibn Abd al-Rahman al-Makhzoumi, on the authority of Hisham ibn Urwa, on the authority of Abd al-Rahman Ibn Al-Qasim, on the authority of his father, on the authority of Aisha: “When Barira was emancipated by Aisha, her husband was a slave, so the Messenger of God, may God bless him and grant him peace, made He greeted her, urging her to do so, so she started saying to the Messenger of God, may God bless him and grant him peace, “Is it not for me to separate from him?” He said: “Yes.” She said: I left him.

أَخْبَرَنَا عَمْرُو بْنُ عَوْنٍ ، أَخْبَرَنَا خَالِدُ بْنُ عَبْدِ اللَّهِ ، عَنْ خَالِدٍ يَعْنِي الْحَذَّاءَ عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ : أَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا يُقَالُ لَهُ : مُغِيثٌ، كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلْعَبَّاسِ : " يَا عَبَّاسُ،أَلَا تَعْجَبُ مِنْ شِدَّةِ حُبِّ مُغِيثٍ بَرِيرَةَ ، وَمِنْ شِدَّةِ بُغْضِ بَرِيرَةَ مُغِيثًا؟ " فَقَالَ لَهَا : " لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ "، فَقَالَتْ : يَا رَسُولَ اللَّهِ أَتَأْمُرُنِي؟ قَال : " إِنَّمَا أَنَا شَافِعٌ "، قَالَتْ : لَا حَاجَةَ لِي فِيهِ
Amr ibn Aoun informed us, Khalid ibn Abdullah informed us, on the authority of Khaled, meaning the shoe, on the authority of Ikrimah, on the authority of Ibn Abbas: Barira’s husband was a slave called Mughith, as if I could see him walking around behind her, crying with tears running down his beard. The Prophet, may God’s prayers and peace be upon him, said: He, peace and blessings be upon him, said to Abbas: “O Abbas, aren’t you amazed at how much Mughith loves Barira and how much Barira hates Mughith?” So he said to her: “If “You went back to him, for he is the father of your son.” She said: “O Messenger of God, do you command me?” He said: “I am only an intercessor.” She said: I have no need of it.

أَخْبَرَنَا أَبُو عَاصِمٍ ، حَدَّثَنَا ابْنُ جُرَيْجٍ ، قَالَ : أَخْبَرَنِي زِيَادُ بْنُ سَعْدٍ ، عَنْ هِلَالِ بْنِ أُسَامَةَ ، عَنْ أَبِي مَيْمُونَةَ سُلَيْمَانَ مَوْلًى لِأَهْلِ الْمَدِينَةِ ، قَالَ : كُنْتُ عِنْدَ أَبِي هُرَيْرَةَ فَجَاءَتْهُ امْرَأَةٌ، فَقَالَتْ : إِنَّ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِوَلَدِي، فَقَالَ أَبُو هُرَيْرَةَ : كُنْتُ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذْ جَاءَتْهُ امْرَأَةٌ، فَقَالَتْ : إِنَّ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِوَلَدِي أَوْ بِابْنِي وَقَدْ نَفَعَنِي وَسَقَانِي مِنْ بِئْرِ أَبِي عِنَبَةَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : اسْتَهِمَا أَوْ قَالَ : تَسَاهَمَا أَبُو عَاصِمٍ الشَّاكُّ ، فَجَاءَ زَوْجُهَا، فَقَالَ : مَنْ يُخَاصِمُنِي فِي وَلَدِي أَوْ فِي ابْنِي؟، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " يَا غُلَامُ،هَذَا أَبُوكَ وَهَذِهِ أُمُّكَ، فَخُذْ بِيَدِ أَيِّهِمَا شِئْتَ ".
وَقَدْ قَالَ أَبُو عَاصِمٍ : " فَاتْبَعْ أَيَّهُمَا شِئْتَ "، فَأَخَذَ بِيَدِ أُمِّهِ فَانْطَلَقَتْ بِهِ
Abu Asim told us, Ibn Jurayj told us, he said: Ziyad bin Saad told me, on the authority of Hilal bin Usama, on the authority of Abu Maymunah Sulayman A servant of the people of Medina. He said: I was with Abu Hurairah and a woman came to him and said: My husband wants to take my son away, so he said Abu Huraira: I was with the Messenger of God, may God bless him and grant him peace, when a woman came to him and said: My husband wants to take my son or son away. He benefited me by giving me a drink from the well of Abu Anabah, and the Messenger of God, may God bless him and grant him peace, said: They contributed, or he said: Abu Anba contributed. Asim was suspicious, so her husband came and said: Who will dispute with me regarding my child or my son? Then the Messenger of God, may God bless him and grant him peace, said: “O boy, this This is your father and this is your mother, so take by the hand whichever you wish.” Abu Asim said: “Then follow whichever you wish.” So he took his mother’s hand and she set off with him.

أَخْبَرَنَا أَبُو عَاصِمٍ ، أَخْبَرَنَا ابْنُ جُرَيْجٍ ، أَخْبَرَنِي مُظَاهِرٌ وَهُوَ ابْنُ أَسْلَمَ ، أَنَّهُ سَمِعَ الْقَاسِمَ بْنَ مُحَمَّدٍ ، عَنْ عَائِشَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ :" لِلْأَمَةِ تَطْلِيقَتَانِ وَقُرْؤُهَا حَيْضَتَانِ ".
قَالَ أَبُو عَاصِمٍ : سَمِعْتُهُ مِنْ مُظَاهِرٍ
Abu Asim told us, Ibn Jurayj told us, Mazhar, who is Ibn Aslam, told me that he heard Al-Qasim bin Muhammad, on the authority of Aisha, On the authority of the Prophet, may God’s prayers and peace be upon him, he said: “A female slave has two divorces, and her married woman has two menstrual cycles.” Abu Asim said: I heard it from Mazahir.

أَخْبَرَنَا عَمْرُو بْنُ عَوْنٍ ، أَخْبَرَنَا شَرِيكٌ ، عَنْ قَيْسِ بْنِ وَهْبٍ ، عَنْ أَبِي الْوَدَّاكِ ، عَنْ أَبِي سَعِيدٍ وَرَفَعَهُ أَنَّهُ قَالَ فِي سَبَايَا أَوْطَاسٍ :" لَا تُوطَأُ حَامِلٌ حَتَّى تَضَعَ حَمْلَهَا، وَلَا غَيْرُ ذَاتِ حَمْلٍ حَتَّى تَحِيضَ حَيْضَةً "
Amr ibn Aoun informed us, Sharik informed us, on the authority of Qays ibn Wahb, on the authority of Abu al-Waddak, on the authority of Abu Sa`id, and he narrated it, that he said in “A pregnant woman shall not have intercourse until she has given birth, nor shall a pregnant woman have intercourse until she has had her menstrual cycle.”
