أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أنبأنا هَمَّامٌ ، عَنْ قَتَادَةَ ، قَال : # إِذَا حَضَرَ أَحَدَكُمُ الْمَوْتُ إِنْ تَرَكَ خَيْرًا الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالأَقْرَبِينَ بِالْمَعْرُوفِ حَقًّا عَلَى الْمُتَّقِينَ سورة البقرة آية 180 #،فَأَمَرَ أَنْ يُوصِيَ لِوَالِدَيْهِ وَأَقَارِبِهِ، ثُمَّ نُسِخَ بَعْدَ ذَلِكَ فِي سُورَةِ النِّسَاءِ ، فَجَعَلَ لِلْوَالِدَيْنِ نَصِيبًا مَعْلُومًا، وَأَلْحَقَ لِكُلِّ ذِي مِيرَاثٍ نَصِيبَهُ مِنْهُ، وَلَيْسَتْ لَهُمْ وَصِيَّةٌ، فَصَارَتْ الْوَصِيَّةُ لِمَنْ لَا يَرِثُ مِنْ قَرِيبٍ وَغَيْرِهِ "
Yazid bin Harun told us, Hammam told us, on the authority of Qatada, he said: #When death approaches one of you, if he leaves behind good, he will make a bequest to the parents. And the closest relatives, in a kind manner, is a duty upon the righteous. Surah Al-Baqarah, verse 180 # So he was commanded to make a bequest to his parents and relatives, then it was abrogated after that in Surah Women, so he assigned to the parents a specified share, and assigned to everyone who had an inheritance his share of it, and they had no will, so the will became for those who had no inheritance. He inherits from a relative and others.”
