حَدَّثَنَا أَبُو الْوَلِيدِ ، حَدَّثَنَا هَمَّامٌ ، عَنْ قَتَادَةَ ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ الْحِمْيَرِيِّ ، قَالَ :" لَا يَجُوزُ طَلَاقٌ، وَلَا وَصِيَّةٌ، إِلَّا فِي عَقْلٍ، إِلَّا النَّشْوَانَ، يَعْنِي : السَّكْرَانَ، فَإِنَّهُ يَجُوزُ طَلَاقُهُ، وَيُضْرَبُ ظَهْرُهُ "
Abu Al-Walid narrated to us, Hammam narrated to us, on the authority of Qatada, on the authority of Humaid bin Abdul-Rahman Al-Himyari, who said: “Divorce is not permissible, nor is A commandment, except when one is of sound mind, except when one is drunk, meaning one who is drunk, in which case it is permissible to divorce him, and his back may be beaten.”
