حَدَّثَنَا زَكَرِيَّا بْنُ عَدِيٍّ ، حَدَّثَنَا عُبَيْدُ اللَّهِ هُوَ ابْنُ عَمْرٍو ، عَنْ عَبْدِ الْكَرِيمِ ، عَنْ الْحَكَمِ ، قَالَ :" إِذَا قَتَلَ الرَّجُلُ أَخَاهُ عَمْدًا، لَمْ يُوَرَّثْ مِنْ مِيرَاثِهِ، وَلَا مِنْ دِيَتِهِ، فَإِذَا قَتَلَهُ خَطَأً، وُرِّثَ مِنْ مِيرَاثِهِ، وَلَمْ يُوَرَّثْ مِنْ دِيَتِهِ.
قَالَ : وَكَانَ عَطَاءٌ يَقُولُ ذَلِكَ
