أَخْبَرَنَا مَرْوَانُ بْنُ مُحَمَّدٍ ، حَدَّثَنَا سَعِيدٌ ، عَنْ مَكْحُولٍ ، قَالَ :" إِذَا تَصَدَّقَ الرَّجُلُ عَلَى بَعْضِ وَرَثَتِهِ وَهُوَ صَحِيحٌ بِأَكْثَرَ مِنْ النِّصْفِ، رُدَّ إِلَى الثُّلُثِ، وَإِذَا أَعْطَى النِّصْفَ، جَازَ لَهُ ذَلِكَ ".
قَالَ سَعِيدٌ : وَكَانَ قُضَاةُ أَهْلِ دِمَشْقَ يَقْضُونَ بِذَلِكَ
Marwan bin Muhammad told us, Sa`id told us, on the authority of Makhoul, who said: “If a man gives in charity to some of his heirs while he is healthy, more than The half is returned to the third, and if he gives the half, it is permissible for him to do so.”
