حَدَّثَنَا عُقْبَةُ بْنُ مُكْرَمٍ الْعَمِّيُّ الْبَصْرِيُّ، وَغَيْرُ، وَاحِدٍ، قَالُوا حَدَّثَنَا مُحَمَّدُ بْنُ بَكْرٍ الْبُرْسَانِيُّ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ قَتَادَةَ، وَعَاصِمٍ الأَحْوَلِ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏"‏ مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى وَلاَ نَعْلَمُ أَحَدًا ذَكَرَ فِي هَذَا الْحَدِيثِ عَاصِمًا الأَحْوَلَ عَنْ حَمَّادِ بْنِ سَلَمَةَ غَيْرَ مُحَمَّدِ بْنِ بَكْرٍ ‏.‏ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ ‏.‏ - وَقَدْ رُوِيَ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏"‏ مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ ‏"‏ ‏.‏ رَوَاهُ ضَمْرَةُ بْنُ رَبِيعَةَ عَنِ الثَّوْرِيِّ عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏ وَلَمْ يُتَابَعْ ضَمْرَةُ عَلَى هَذَا الْحَدِيثِ وَهُوَ حَدِيثٌ خَطَأٌ عِنْدَ أَهْلِ الْحَدِيثِ ‏.‏
Uqba bin Makram Al-Ammi Al-Basri, and more than one person, narrated to us. They said, Muhammad bin Bakr Al-Barsani narrated to us, on the authority of Hammad bin Salamah, on the authority of Qatada, and Asim Al-Ahwal, on the authority of Al-Hasan, on the authority of Samurah, on the authority of the Prophet, may God’s prayers and peace be upon him, who said: “Whoever owns a relative of a mahram is free.” Abu Issa said, “We do not know of anyone who mentioned in this hadith Asim who is more knowledgeable on the authority of Hammad ibn Salamah other than Muhammad ibn Bakr. And work on this.” The hadith is according to some people of knowledge. - It was narrated on the authority of Ibn Umar, on the authority of the Prophet, may God bless him and grant him peace, who said: “Whoever owns a relative of a mahram is Hurr. Based on this hadith, it is an incorrect hadith according to the people of hadith.
