Jami' at-Tirmidhi — Hadith #27524

Qutaibah narrated to us, Sharik bin Abdullah Al-Nakha’i narrated to us, on the authority of Abu Ishaq, on the authority of Ata’, on the authority of Rafi’ bin Khadij, that the Prophet, may God’s prayers and peace be upon him, said “ “Whoever plants on a people’s land without their permission does not get anything from the crop and he has the right to spend on it.” Abu Issa said this is a good hadith. It is strange and we do not know it from the hadith of Abu Ishaq except from this point of view from the hadith of Sharik bin Abdullah. And this hadith should be acted upon when Some people of knowledge say this is the view of Ahmad and Ishaq. I asked Muhammad bin Ismail about this hadith and he said it is a hasan hadith. And he said no I know it from the hadith of Abu Ishaq, except from the narration of Sharik. Muhammad said: Maqil bin Malik Al-Basri narrated to us, Uqba bin Al-Asam narrated to us, On the authority of Ata’, on the authority of Rafi’ bin Khadij, on the authority of the Prophet, may God bless him and grant him peace, and something similar.
