حَدَّثَنَا عَلِيُّ بْنُ سَعِيدٍ الْكِنْدِيُّ الْكُوفِيُّ، حَدَّثَنَا ابْنُ أَبِي زَائِدَةَ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَضَى رَسُولُ اللَّهِ صلى الله عليه وسلم فِي الْجَنِينِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ ‏.‏ فَقَالَ الَّذِي قُضِيَ عَلَيْهِ أَنُعْطِي مَنْ لاَ شَرِبَ وَلاَ أَكَلَ وَلاَ صَاحَ فَاسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ ‏.‏ فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏ "‏ إِنَّ هَذَا لَيَقُولُ بِقَوْلِ شَاعِرٍ بَلْ فِيهِ غُرَّةٌ عَبْدٌ أَوْ أَمَةٌ ‏"‏ ‏.‏ وَفِي الْبَابِ عَنْ حَمَلِ بْنِ مَالِكِ بْنِ النَّابِغَةِ وَالْمُغِيرَةِ بْنِ شُعْبَةَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ ‏.‏ وَقَالَ بَعْضُهُمُ الْغُرَّةُ عَبْدٌ أَوْ أَمَةٌ أَوْ خَمْسُمِائَةِ دِرْهَمٍ ‏.‏ وَقَالَ بَعْضُهُمْ أَوْ فَرَسٌ أَوْ بَغْلٌ ‏.‏
Ali bin Saeed Al-Kindi Al-Kufi told us, Ibn Abi Zaida told us, on the authority of Muhammad bin Amr, on the authority of Abu Salamah, on the authority of Abu Hurairah, he said The Messenger of God, may God’s prayers and peace be upon him, made a ruling regarding the fetus with the forelock of a male or female slave. The one on whom the ruling was made said, “Should we give one who neither drinks nor eats nor He shouted and began, and something similar to that appears. The Prophet, may God’s prayers and peace be upon him, said, “Indeed, this is spoken by a poet, but there is in it the temptation of a male or female slave.” On the authority of Hamal bin Malik bin Al-Nabigha and Al-Mughirah bin Shu’bah. Abu Issa said the hadith of Abu Hurairah is a good and authentic hadith. This is according to the people of knowledge. Some of them said: A foreign man is a male or female slave or five hundred dirhams. And some of them said or A horse or a mule...
