أَخْبَرَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا حَسَنٌ ، عَنْ أَبِي سَهْلٍ ، عَنْ الشَّعْبِيِّ قَالَ : قَالَ عَلِيٌّ فِي ابْنِ الْمُلَاعَنَةِ :" تَرَكَ أَخَاهُ لِأُمِّهِ، وَأُمَّهُ لِأَخِيهِ السُّدُسُ، وَلِأُمِّهِ الثُّلُثُ، ثُمَّ يُرَدُّ عَلَيْهِمْ، فَيَصِيرُ لِلْأَخِ الثُّلُثُ، وَلِلْأُمِّ الثُّلُثَانِ ".
وَقَالَ ابْنُ مَسْعُودٍ : لِأَخِيهِ السُّدُسُ، وَمَا بَقِيَ فَلِلْأُمِّ
Abu Nu’aym told us, Hassan told us, on the authority of Abu Sahl, on the authority of Al-Sha’bi, who said: Ali said regarding Ibn Al-Mula’ana: “He left his brother to his mother. And his mother gets a sixth for his brother, and for his mother a third. Then it is returned to them, so the brother gets a third, and the mother gets two-thirds.” Ibn Masoud said: to his brother One-sixth, and what remains goes to the mother
