حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ، أَخْبَرَنَا إِسْمَاعِيلُ بْنُ جَعْفَرٍ، حَدَّثَنَا جَعْفَرُ بْنُ مُحَمَّدٍ، عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ . قَالَ وَقَضَى بِهَا عَلِيٌّ فِيكُمْ . قَالَ أَبُو عِيسَى وَهَذَا أَصَحُّ وَهَكَذَا رَوَى سُفْيَانُ الثَّوْرِيُّ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ عَنِ النَّبِيِّ صلى الله عليه وسلم مُرْسَلاً . وَرَوَى عَبْدُ الْعَزِيزِ بْنُ أَبِي سَلَمَةَ وَيَحْيَى بْنُ سُلَيْمٍ هَذَا الْحَدِيثَ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ عَنْ عَلِيٍّ عَنِ النَّبِيِّ صلى الله عليه وسلم . وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ رَأَوْا أَنَّ الْيَمِينَ مَعَ الشَّاهِدِ الْوَاحِدِ جَائِزٌ فِي الْحُقُوقِ وَالأَمْوَالِ . وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ وَالشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ وَقَالُوا لاَ يُقْضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ إِلاَّ فِي الْحُقُوقِ وَالأَمْوَالِ . وَلَمْ يَرَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَهْلِ الْكُوفَةِ وَغَيْرِهِمْ أَنْ يُقْضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ .
Ali bin Hajar told us, Ismail bin Ja’far told us, Ja’far bin Muhammad told us, on the authority of his father, that the Prophet, may God’s prayers and peace be upon him, took an oath with The one witness. He said, “Ali decided it among you.” Abu Issa said, “This is more correct.” And this is how Sufyan Al-Thawri narrated on the authority of Ja`far bin Muhammad, on the authority of his father, on the authority of the Prophet, may God bless him and grant him peace, on the authority of Abdul Aziz bin Abi Salamah and Yahya bin Sulaym, narrated this hadith on the authority of Jafar bin Muhammad, on the authority of his father, on the authority of Ali, on the authority of the Prophet, may God bless him and grant him peace. This is acted upon according to some of the people of knowledge among the companions of The Prophet (peace and blessings of Allaah be upon him) and others have seen that the righteous are with the One Witness, who is capable of righteousness and wealth. It is the saying of Malik bin Anas, Al-Shafi 'i, Ahmad, Ishaq, and Ishaq. They said that the oath is not to be judged with the one witness except in truth and wealth. And he did not see some of them The people of knowledge from among the people of the Kufah and others to be judged in the oaths with the one witness.
