حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنْ إِسْمَاعِيلَ بْنِ مُسْلِمٍ، عَنِ الْحَسَنِ، عَنْ جُنْدَبٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ حَدُّ السَّاحِرِ ضَرْبَةٌ بِالسَّيْفِ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ لاَ نَعْرِفُهُ مَرْفُوعًا إِلاَّ مِنْ هَذَا الْوَجْهِ ‏.‏ وَإِسْمَاعِيلُ بْنُ مُسْلِمٍ الْمَكِّيُّ يُضَعَّفُ فِي الْحَدِيثِ وَإِسْمَاعِيلُ بْنُ مُسْلِمٍ الْعَبْدِيُّ الْبَصْرِيُّ قَالَ وَكِيعٌ هُوَ ثِقَةٌ ‏.‏ وَيُرْوَى عَنِ الْحَسَنِ أَيْضًا وَالصَّحِيحُ عَنْ جُنْدَبٍ مَوْقُوفٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ ‏.‏ وَقَالَ الشَّافِعِيُّ إِنَّمَا يُقْتَلُ السَّاحِرُ إِذَا كَانَ يَعْمَلُ فِي سِحْرِهِ مَا يَبْلُغُ بِهِ الْكُفْرَ فَإِذَا عَمِلَ عَمَلاً دُونَ الْكُفْرِ فَلَمْ نَرَ عَلَيْهِ قَتْلاً ‏.‏
Ahmad bin Mani’ told us, Abu Muawiyah told us, on the authority of Ismail bin Muslim, on the authority of Al-Hasan, on the authority of Jundub, he said: The Messenger of God, may God bless him and grant him peace, said: “The magician’s punishment is a blow with the sword.” Abu Issa said: This is a hadith that we do not know of as being traced back to the Prophet except from this chain of transmission. And Ismail bin Muslim Al-Makki is weakened in the hadith, and Ismail bin Muslim Al-Abdi Al-Basri said: Waki’ is trustworthy. It is also narrated on the authority of Al-Hasan The authentic one is on the authority of a grasshopper, and it is authentic. This hadith is acted upon according to some people of knowledge among the companions of the Prophet, may God bless him and grant him peace, and others. This is the saying of Malik bin Anas. Al-Shafi’i said: The magician is only killed if he performs in his magic what amounts to disbelief. He committed an act other than disbelief, and we did not see him being killed.
