حَدَّثَنَا بِذَلِكَ الْحَسَنُ بْنُ عَلِيٍّ الْخَلاَّلُ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَنْبَأَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، أَنَّ رَجُلاً، مِنْ أَسْلَمَ جَاءَ إِلَى النَّبِيِّ صلى الله عليه وسلم فَاعْتَرَفَ بِالزِّنَا فَأَعْرَضَ عَنْهُ ثُمَّ اعْتَرَفَ فَأَعْرَضَ عَنْهُ حَتَّى شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ فَقَالَ النَّبِيُّ صلى الله عليه وسلم " أَبِكَ جُنُونٌ " . قَالَ لاَ . قَالَ " أَحْصَنْتَ " . قَالَ نَعَمْ . قَالَ فَأَمَرَ بِهِ فَرُجِمَ بِالْمُصَلَّى فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ فَرَّ فَأُدْرِكَ فَرُجِمَ حَتَّى مَاتَ فَقَالَ لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم خَيْرًا وَلَمْ يُصَلِّ عَلَيْهِ . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ . وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ أَنَّ الْمُعْتَرِفَ بِالزِّنَا إِذَا أَقَرَّ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ أُقِيمَ عَلَيْهِ الْحَدُّ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ . وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ إِذَا أَقَرَّ عَلَى نَفْسِهِ مَرَّةً أُقِيمَ عَلَيْهِ الْحَدُّ وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ وَالشَّافِعِيِّ . وَحُجَّةُ مَنْ قَالَ هَذَا الْقَوْلَ حَدِيثُ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللَّهِ إِنَّ ابْنِي زَنَى بِامْرَأَةِ هَذَا الْحَدِيثَ بِطُولِهِ وَقَالَ النَّبِيُّ صلى الله عليه وسلم " اغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا " . وَلَمْ يَقُلْ فَإِنِ اعْتَرَفَتْ أَرْبَعَ مَرَّاتٍ .
Al-Hasan bin Ali Al-Khallal told us about that, Abdul Razzaq told us, Muammar told us, on the authority of Al-Zuhri, on the authority of Abu Salamah bin Abdul Rahman, On the authority of Jabir bin Abdullah, that a man who had converted to Islam came to the Prophet, may God bless him and grant him peace, and he confessed to adultery and he turned away from it. Then He confessed and turned away from it until he bore four testimonies against himself, and the Prophet, may God’s prayers and peace be upon him, said, “Are you crying mad?” He said, “No.” He said. “You have done well.” He said, “Yes.” He said, “So he ordered that he be stoned in the prayer place. When the stones hit him, he fled and caught up, so he was stoned until he died.” He told him The Messenger of God, may God bless him and grant him peace, did not pray for him. Abu Issa said: This is a hasan and authentic hadith. This hadith is acted upon according to some of the people of Knowing that if a person who confesses to adultery confesses it four times, the punishment will be imposed on him. This is the view of Ahmad and Ishaq. Some of the people of knowledge said that if he confesses to himself once, the punishment will be imposed on him. This is the saying of Malik bin Anas and Al-Shafi’i. And the evidence of This saying is the hadith of Abu Hurairah and Zayd bin Khalid, that two men disputed with the Messenger of God, may God bless him and grant him peace, and one of them said, O Messenger By God, my son committed adultery with a woman. This is the length of the hadith. The Prophet, may God’s prayers and peace be upon him, said: “Go, O Anis, with this woman. If she confesses, stone her.” "And he did not say, 'If she confesses four times.'
