حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَخْبَرَهُ أَنَّ امْرَأَةً وُجِدَتْ فِي بَعْضِ مَغَازِي رَسُولِ اللَّهِ صلى الله عليه وسلم مَقْتُولَةً فَأَنْكَرَ رَسُولُ اللَّهِ صلى الله عليه وسلم ذَلِكَ وَنَهَى عَنْ قَتْلِ النِّسَاءِ وَالصِّبْيَانِ ‏.‏ وَفِي الْبَابِ عَنْ بُرَيْدَةَ وَرَبَاحٍ وَيُقَالُ رِيَاحُ بْنُ الرَّبِيعِ وَالأَسْوَدِ بْنِ سَرِيعٍ وَابْنِ عَبَّاسٍ وَالصَّعْبِ بْنِ جَثَّامَةَ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ كَرِهُوا قَتْلَ النِّسَاءِ وَالْوِلْدَانِ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَالشَّافِعِيِّ ‏.‏ وَرَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ فِي الْبَيَاتِ وَقَتْلِ النِّسَاءِ فِيهِمْ وَالْوِلْدَانِ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ وَرَخَّصَا فِي الْبَيَاتِ ‏.‏
Qutaibah told us, Al-Layth told us, on the authority of Nafi’, on the authority of Ibn Umar, he told him that a woman was found in one of the raids of the Messenger of God, may God bless him and grant him peace. She was killed, and the Messenger of God, may God bless him and grant him peace, denounced that and forbade the killing of women and children. And in the chapter on the authority of Buraydah and Rabah, and it is said Riyah bin Al-Rabi’, Al-Aswad bin Sari’, Ibn Abbas, and Al-Sa’b bin Jathama. Abu Issa said: This is a good and authentic hadith. And the work. Based on this, according to some people of knowledge among the companions of the Prophet, may God bless him and grant him peace, and others, they disliked killing women and children, and this is the saying of Sufyan. Al-Thawri and Al-Shafi’i. Some of the scholars permitted the killing of women and children in homes, and this is the view of Ahmad and Ishaq. And they made it easy in the nights
