حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا أَيُّوبُ، عَنْ أَبِي قِلاَبَةَ، عَنْ عَمِّهِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم فَدَى رَجُلَيْنِ مِنَ الْمُسْلِمِينَ بِرَجُلٍ مِنَ الْمُشْرِكِينَ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَعَمُّ أَبِي قِلاَبَةَ هُوَ أَبُو الْمُهَلَّبِ وَاسْمُهُ عَبْدُ الرَّحْمَنِ بْنُ عَمْرٍو وَيُقَالُ مُعَاوِيَةُ بْنُ عَمْرٍو وَأَبُو قِلاَبَةَ اسْمُهُ عَبْدُ اللَّهِ بْنُ زَيْدٍ الْجَرْمِيُّ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ أَنَّ لِلإِمَامِ أَنْ يَمُنَّ عَلَى مَنْ شَاءَ مِنَ الأُسَارَى وَيَقْتُلَ مَنْ شَاءَ مِنْهُمْ وَيَفْدِيَ مَنْ شَاءَ ‏.‏ وَاخْتَارَ بَعْضُ أَهْلِ الْعِلْمِ الْقَتْلَ عَلَى الْفِدَاءِ ‏.‏ وَقَالَ الأَوْزَاعِيُّ بَلَغَنِي أَنَّ هَذِهِ الآيَةَ مَنْسُوخَةٌ قَوْلُهُ تَعَالَى‏:‏ ‏(‏فَإِِمَّا مَنًّا بَعْدُ وَإِمَّا فِدَاءً‏)‏ نَسَخَتْهَا‏:‏ ‏(‏وَاقْتُلُوهُمْ حَيْثُ ثَقِفْتُمُوهُمْ ‏)‏ حَدَّثَنَا بِذَلِكَ هَنَّادٌ حَدَّثَنَا ابْنُ الْمُبَارَكِ عَنِ الأَوْزَاعِيِّ ‏.‏ قَالَ إِسْحَاقُ بْنُ مَنْصُورٍ قُلْتُ لأَحْمَدَ إِذَا أُسِرَ الأَسِيرُ يُقْتَلُ أَوْ يُفَادَى أَحَبُّ إِلَيْكَ قَالَ إِنْ قَدَرُوا أَنْ يُفَادُوا فَلَيْسَ بِهِ بَأْسٌ وَإِنْ قُتِلَ فَمَا أَعْلَمُ بِهِ بَأْسًا ‏.‏ قَالَ إِسْحَاقُ بْنُ إِبْرَاهِيمَ الإِثْخَانُ أَحَبُّ إِلَىَّ إِلاَّ أَنْ يَكُونَ مَعْرُوفًا فَأَطْمَعُ بِهِ الْكَثِيرَ ‏.‏
Ibn Abi Umar narrated to us, Sufyan narrated to us, Ayoub narrated to us, on the authority of Abu Qilaba, on the authority of his uncle, on the authority of Imran bin Husayn, that the Prophet, may God bless him and grant him peace, ransomed Two men from the Muslims for a man from the polytheists. And Abu Qilaba’s uncle is Abu Al-Muhallab, whose name is Abdul Rahman bin Amr, and he is also called Muawiyah bin Amr, and Abu Qalaba, whose name is Abdullah bin Zaid Al-Jarmi. And the work. Based on this, according to most of the people of knowledge among the Companions of the Prophet, may God bless him and grant him peace, and others, the Imam has the right to grant blessings to whomever he wishes. captives, and he kills whomever he wants of them and ransomes whomever he wants. Some of the people of knowledge chose killing rather than ransom. Al-Awza’i said, “I have heard This verse has been abrogated. The Almighty’s saying: (Either as a reward from us or as a ransom) has been abrogated: (And kill them wherever you find them. (Hannad narrated to us, Ibn Al-Mubarak narrated to us, on the authority of Al-Awza’i. Ishaq bin Mansour said: I said to Ahmad: If the prisoner is captured, he will be killed. Or the most beloved to you may be ransomed. He said, “If they are able to ransom, then there is no harm in it. If he is killed, then I do not know of any harm in it.” Ishaq bin Ibrahim said. I prefer to be well-known, and I covet it greatly.
