حَدَّثَنَا ابْنُ أَبِي عُمَرَ، قال: حَدَّثَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ عَوْسَجَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَجُلاً، مَاتَ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم وَلَمْ يَدَعْ وَارِثًا إِلاَّ عَبْدًا هُوَ أَعْتَقَهُ فَأَعْطَاهُ النَّبِيُّ صلى الله عليه وسلم مِيرَاثَهُ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ ‏.‏ وَالْعَمَلُ عِنْدَ أَهْلِ الْعِلْمِ فِي هَذَا الْبَابِ إِذَا مَاتَ الرَّجُلُ وَلَمْ يَتْرُكْ عَصَبَةً أَنَّ مِيرَاثَهُ يُجْعَلُ فِي بَيْتِ مَالِ الْمُسْلِمِينَ ‏.‏
Ibn Abi Umar told us, he said: Sufyan told us, on the authority of Amr bin Dinar, on the authority of Awsaja, on the authority of Ibn Abbas, that a man died during the reign of the Messenger of God. God, may God bless him and grant him peace, did not leave an heir except a slave whom he freed, and the Prophet, may God bless him and grant him peace, gave him his inheritance. Abu Issa said this hadith. Good. And according to the people of knowledge in this matter, if a man dies and does not leave a descendant, his inheritance is placed in the treasury of the Muslims. .
