حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا أَبُو شِهَابٍ ، عَنْ الشَّيْبَانِيِّ ، عَنْ الشَّعْبِيِّ : فِي الْعَبْدِ يَتَزَوَّجُ الْمَرْأَةَ، ثُمَّ يُطَلِّقُهَا وَلَهُ مِنْهَا وَلَدٌ؟ قَالَ :" إِنْ كَانَتْ حُرَّةً، فَالنَّفَقَةُ عَلَى أُمِّهِ، وَإِنْ كَانَ عَبْدًا، يَعْنِي : الصَّبِيَّ، فَعَلَى مُوَالِيهِ "
Ahmad bin Abdullah narrated to us, Abu Shihab narrated to us, on the authority of Al-Shaybani, on the authority of Al-Sha’bi: In a slave who marries a woman and then divorces her. And he has a son from her? He said: “If she is free, then the maintenance is on his mother, and if he is a slave, meaning: the boy, then on his master.”
