Jami' at-Tirmidhi — Hadith #27313

Hanad narrated to us, Abu Muawiyah narrated to us, on the authority of Al-A’mash, on the authority of Ibrahim, on the authority of Al-Aswad, on the authority of Aisha, she said, Barira’s husband was free. So the Messenger of God, may God bless him and grant him peace, gave her the choice. Abu Issa said that the hadith of Aisha is a good and authentic hadith. This is how Hisham narrated on the authority of his father, on the authority of Aisha. She said Barira’s husband was a slave. Ikrimah narrated on the authority of Ibn Abbas, who said: I saw Barira’s husband, and he was a slave called Mughith. And so on. It was narrated on the authority of Ibn Omar. This is acted upon according to some people of knowledge, and they said, “If a female slave is under heat and is freed, then she has no choice.” But She will have the choice if she is freed and is under a slave. This is the view of Al-Shafi’i, Ahmad, and Ishaq. Al-A’mash narrated on the authority of Ibrahim, on the authority of Al-Aswad, on the authority of Aisha, said: Bareerah’s husband was free, so the Messenger of God, may God bless him and grant him peace, gave her a choice. Abu Awanah narrated this hadith. About Al-A'mash, on the authority of Ibrahim, on the authority of Al-Aswad, on the authority of Aisha, in the story of Bareerah. Al-Aswad said, “And her husband was free.” And this is acted upon according to some The people of knowledge from the Successors and those after them, and this is the opinion of Sufyan al-Thawri and the people of Kufa.
