حَدَّثَنَا مُحَمَّدُ بْنُ رَافِعٍ، حَدَّثَنَا ابْنُ أَبِي فُدَيْكٍ، عَنْ إِبْرَاهِيمَ بْنِ إِسْمَاعِيلَ بْنِ أَبِي حَبِيبَةَ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ
" إِذَا قَالَ الرَّجُلُ لِلرَّجُلِ يَا يَهُودِيُّ فَاضْرِبُوهُ عِشْرِينَ وَإِذَا قَالَ يَا مُخَنَّثُ فَاضْرِبُوهُ عِشْرِينَ وَمَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ فَاقْتُلُوهُ " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ لاَ نَعْرِفُهُ إِلاَّ مِنْ هَذَا الْوَجْهِ . وَإِبْرَاهِيمُ بْنُ إِسْمَاعِيلَ يُضَعَّفُ فِي الْحَدِيثِ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَصْحَابِنَا قَالُوا مَنْ أَتَى ذَاتَ مَحْرَمٍ وَهُوَ يَعْلَمُ فَعَلَيْهِ الْقَتْلُ . وَقَالَ أَحْمَدُ مَنْ تَزَوَّجَ أُمَّهُ قُتِلَ . وَقَالَ إِسْحَاقُ مَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ قُتِلَ . - وَقَدْ رُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم مِنْ غَيْرِ وَجْهٍ رَوَاهُ الْبَرَاءُ بْنُ عَازِبٍ وَقُرَّةُ بْنُ إِيَاسٍ الْمُزَنِيُّ أَنَّ رَجُلاً تَزَوَّجَ امْرَأَةَ أَبِيهِ فَأَمَرَ النَّبِيُّ صلى الله عليه وسلم بِقَتْلِهِ .
Muhammad bin Rafi’ told us, Ibn Abi Fudaik told us, on the authority of Ibrahim bin Ismail bin Abi Habiba, on the authority of Dawud bin Al-Husayn, on the authority of Ikrimah, on the authority of Ibn Abbas, on the authority of the Prophet, may God’s prayers and peace be upon him, said: “If a man says to another, ‘O Jew, hit him twenty times,’ and if he says, ‘O If he is an effeminate person, then strike him twenty times, and whoever commits sexual intercourse with a mahram man, then kill him.” Abu Issa said, “This is a hadith that we do not know except from this.” The face. And Ibrahim bin Ismail is weakened in the hadith. And this is acted upon according to our companions. They said: Whoever has intercourse with a mahram while he is He knows So he must be killed. Ahmad said: Whoever marries his mother will be killed. And Ishaq said: Whoever commits an unlawful act will be killed. - It was narrated on the authority of the Prophet May God’s prayers and peace be upon him, in more than one way. It was narrated by Al-Baraa bin Aazib and Qurrah bin Iyas Al-Muzani, that a man married his father’s wife, so the Prophet ordered May God bless him and grant him peace, by killing him
