حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ، عَنْ بُكَيْرِ بْنِ عَبْدِ اللَّهِ بْنِ الأَشَجِّ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ جَابِرِ بْنِ عَبْدِ اللَّهِ، عَنْ أَبِي بُرْدَةَ بْنِ نِيَارٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم
" لاَ يُجْلَدُ فَوْقَ عَشْرِ جَلَدَاتٍ إِلاَّ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ لاَ نَعْرِفُهُ إِلاَّ مِنْ حَدِيثِ بُكَيْرِ بْنِ الأَشَجِّ . وَقَدِ اخْتَلَفَ أَهْلُ الْعِلْمِ فِي التَّعْزِيرِ وَأَحْسَنُ شَيْءٍ رُوِيَ فِي التَّعْزِيرِ هَذَا الْحَدِيثُ . قَالَ وَقَدْ رَوَى هَذَا الْحَدِيثَ ابْنُ لَهِيعَةَ عَنْ بُكَيْرٍ فَأَخْطَأَ فِيهِ وَقَالَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ جَابِرِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِيهِ عَنِ النَّبِيِّ صلى الله عليه وسلم وَهُوَ خَطَأٌ وَالصَّحِيحُ حَدِيثُ اللَّيْثِ بْنِ سَعْدٍ إِنَّمَا هُوَ عَبْدُ الرَّحْمَنِ بْنُ جَابِرِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِي بُرْدَةَ بْنِ نِيَارٍ عَنِ النَّبِيِّ صلى الله عليه وسلم .
Qutaibah narrated to us, Al-Layth narrated to us, on the authority of Yazid bin Abi Habib, on the authority of Bukayr bin Abdullah bin Al-Ashjaj, on the authority of Sulayman bin Yasar, on the authority of Abdul Rahman bin Jabir bin Abdullah, on the authority of Abu Burdah bin Nayyar, said: The Messenger of God, may God bless him and grant him peace, said: “He shall not be flogged for more than ten days.” “Flashes, except within the limits of God’s punishment.” Abu Issa said: This is a hasan and strange hadith. We do not know it except from the hadith of Bukayr ibn al-Ashjaj. The people of knowledge differed regarding ta’zir, and the best thing that was narrated regarding ta’zir is this hadith. He said: This hadith was narrated by Ibn Lahi’ah on the authority of Bakir, so he made a mistake in it and said, on the authority of Abdul Rahman bin Jabir bin Abdullah, on the authority of his father, on the authority of the Prophet, may God bless him and grant him peace, which is a mistake, but the correct hadith is Al-Layth bin Saad is Abdul Rahman bin Jabir bin Abdullah, on the authority of Abu Burdah bin Nayyar, on the authority of the Prophet, may God bless him and grant him peace.
