حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ، وَهَنَّادٌ، وَأَبُو عَمَّارٍ قَالُوا حَدَّثَنَا عِيسَى بْنُ يُونُسَ، عَنْ مُجَالِدٍ، عَنِ الشَّعْبِيِّ، عَنْ عَدِيِّ بْنِ حَاتِمٍ، قَالَ سَأَلْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنْ صَيْدِ الْبَازِي فَقَالَ ‏"‏ مَا أَمْسَكَ عَلَيْكَ فَكُلْ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ لاَ نَعْرِفُهُ إِلاَّ مِنْ حَدِيثِ مُجَالِدٍ عَنِ الشَّعْبِيِّ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ لاَ يَرَوْنَ بِصَيْدِ الْبُزَاةِ وَالصُّقُورِ بَأْسًا ‏.‏ وَقَالَ مُجَاهِدٌ الْبُزَاةُ هُوَ الطَّيْرُ الَّذِي يُصَادُ بِهِ مِنَ الْجَوَارِحِ الَّتِي قَالَ اللَّهُ تَعَالَى‏:‏ ‏(‏وَمَا عَلَّمْتُمْ مِنَ الْجَوَارِحِ ‏)‏ فَسَّرَ الْكِلاَبَ وَالطَّيْرَ الَّذِي يُصَادُ بِهِ ‏.‏ وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ فِي صَيْدِ الْبَازِي وَإِنْ أَكَلَ مِنْهُ وَقَالُوا إِنَّمَا تَعْلِيمُهُ إِجَابَتُهُ ‏.‏ وَكَرِهَهُ بَعْضُهُمْ وَالْفُقَهَاءُ أَكْثَرُهُمْ قَالُوا يَأْكُلُ وَإِنْ أَكَلَ مِنْهُ ‏.‏
Nasr bin Ali, Hanad, and Abu Ammar narrated to us, saying: Issa bin Yunus narrated to us, on the authority of Mujalid, on the authority of Al-Sha’bi, on the authority of Adi bin Hatim, who said I asked the Messenger of God, may God bless him and grant him peace, about the hunting of the bazi, and he said, “Whatever it catches, eat it.” Abu Issa said, “This is a hadith that we do not know.” Except for the hadith of Mujalid on the authority of Ash-Sha’bi. And this is acted upon according to the people of knowledge. They do not see any harm in hunting falcons and falcons. And he said. The fawn fighter is the bird that is hunted with the prey of which God Almighty said: (And you did not know of the prey) He explained Dogs and the birds that are hunted with them. Some people of knowledge have granted permission to hunt the hawk, even if it eats from it, and they said that it is only to teach it to respond to it. Some of them disliked it, but most of the jurists said it should be eaten, even if they eat some of it.
