حَدَّثَنَا يُوسُفُ بْنُ حَمَّادٍ الْبَصْرِيُّ، حَدَّثَنَا عَبْدُ الأَعْلَى بْنُ عَبْدِ الأَعْلَى، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ أَنَسٍ، أَنَّ رَجُلاً، كَانَ فِي عُقْدَتِهِ ضَعْفٌ وَكَانَ يُبَايِعُ وَأَنَّ أَهْلَهُ أَتَوُا النَّبِيَّ صلى الله عليه وسلم فَقَالُوا يَا رَسُولَ اللَّهِ احْجُرْ عَلَيْهِ ‏.‏ فَدَعَاهُ نَبِيُّ اللَّهِ صلى الله عليه وسلم فَنَهَاهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي لاَ أَصْبِرُ عَنِ الْبَيْعِ ‏.‏ فَقَالَ ‏ "‏ إِذَا بَايَعْتَ فَقُلْ هَاءَ وَهَاءَ وَلاَ خِلاَبَةَ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى وَفِي الْبَابِ عَنِ ابْنِ عُمَرَ ‏.‏ وَحَدِيثُ أَنَسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ وَقَالُوا يُحْجَرُ عَلَى الرَّجُلِ الْحُرِّ فِي الْبَيْعِ وَالشِّرَاءِ إِذَا كَانَ ضَعِيفَ الْعَقْلِ ‏.‏ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ ‏.‏ وَلَمْ يَرَ بَعْضُهُمْ أَنْ يُحْجَرَ عَلَى الْحُرِّ الْبَالِغِ ‏.‏
Yusuf bin Hammad Al-Basri narrated to us, Abd al-A’la bin Abd al-A’la narrated to us, on the authority of Sa’id, on the authority of Qatada, on the authority of Anas, that a man was in His complex was weak, and he was pledging allegiance, and his family came to the Prophet, may God bless him and grant him peace, and they said, O Messenger of God, quarantine him. So the Prophet of God called him May God’s prayers and peace be upon him, so he forbade him and said, O Messenger of God, I am not patient with the sale. So he said, “When you give the pledge of allegiance, say ‘haa’, ‘haa’, and ‘la khalaba’.” Abu Issa said, and on the authority of Ibn Omar, the hadith of Anas is a good, authentic, and strange hadith. This hadith is acted upon according to some of the people of Knowledge and they said that a free man is prohibited from buying and selling if he is weak of mind. This is the saying of Ahmad and Ishaq. He did not see Some of them are to be interned as a free adult.
