حَدَّثَنَا قُتَيْبَةُ، وَأَحْمَدُ بْنُ مَنِيعٍ، قَالاَ حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم وَقَالَ قُتَيْبَةُ يَبْلُغُ بِهِ النَّبِيَّ صلى الله عليه وسلم قَالَ
" لاَ تَنَاجَشُوا " . قَالَ وَفِي الْبَابِ عَنِ ابْنِ عُمَرَ وَأَنَسٍ . قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ . كَرِهُوا النَّجْشَ . قَالَ أَبُو عِيسَى وَالنَّجْشُ أَنْ يَأْتِيَ الرَّجُلُ الَّذِي يَفْصِلُ السِّلْعَةَ إِلَى صَاحِبِ السِّلْعَةِ فَيَسْتَامُ بِأَكْثَرَ مِمَّا تَسْوَى وَذَلِكَ عِنْدَمَا يَحْضُرُهُ الْمُشْتَرِي يُرِيدُ أَنْ يَغْتَرَّ الْمُشْتَرِي بِهِ وَلَيْسَ مِنْ رَأْيِهِ الشِّرَاءُ إِنَّمَا يُرِيدُ أَنْ يَخْدَعَ الْمُشْتَرِيَ بِمَا يَسْتَامُ وَهَذَا ضَرْبٌ مِنَ الْخَدِيعَةِ . قَالَ الشَّافِعِيُّ وَإِنْ نَجَشَ رَجُلٌ فَالنَّاجِشُ آثِمٌ فِيمَا يَصْنَعُ وَالْبَيْعُ جَائِزٌ لأَنَّ الْبَائِعَ غَيْرُ النَّاجِشِ .
Qutaybah and Ahmad ibn Mani` narrated to us, they said, Sufyan narrated to us, on the authority of al-Zuhri, on the authority of Sa`id ibn al-Musayyab, on the authority of Abu Hurairah, he said, the Messenger of God said God, may God’s prayers and peace be upon him, and Qutayba said that the Prophet, may God’s prayers and peace be upon him, conveyed it. He said, “Do not argue.” He said, and in the chapter on the authority of Ibn Umar. And Anas. Abu Issa said the hadith of Abu Hurairah is a hasan and authentic hadith. This is acted upon according to the people of knowledge. They disliked deconstruction. Abu Issa and the Najsh said that the man who separates the commodity comes to the owner of the commodity and receives more than it was paid for, and that is when The buyer brings it. He wants the buyer to be deceived by it, and it is not his intention to buy. Rather, he wants to deceive the buyer in a way that is undesirable, and this is a type of thing. From deception. Al-Shafi’i said: If a man commits fraud, then the one who commits fraud is sinful in what he does, and the sale is permissible because the seller is not fraudulent. .
