حَدَّثَنَا قُتَيْبَةُ، عَنْ مَالِكِ بْنِ أَنَسٍ، عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَفْعَلْ ‏"‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ أُمِّ سَلَمَةَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ أَنَّ الْكَفَّارَةَ قَبْلَ الْحِنْثِ تُجْزِئُ وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ وَالشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ ‏.‏ وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ لاَ يُكَفِّرُ إِلاَّ بَعْدَ الْحِنْثِ ‏.‏ قَالَ سُفْيَانُ الثَّوْرِيُّ إِنْ كَفَّرَ بَعْدَ الْحِنْثِ أَحَبُّ إِلَىَّ وَإِنْ كَفَّرَ قَبْلَ الْحِنْثِ أَجْزَأَهُ ‏.‏
Qutaibah narrated to us, on the authority of Malik ibn Anas, on the authority of Suhail ibn Abi Salih, on the authority of his father, on the authority of Abu Hurairah, on the authority of the Prophet, may God’s prayers and peace be upon him, who said: “Whoever swears an oath On the right hand and saw something better than it, let him atone for his oath and do so.” He said, and in the chapter on the authority of Umm Salama. Abu said. Jesus, the hadith of Abu Hurairah, is a hasan and authentic hadith. The action on this according to most of the people of knowledge among the companions of the Prophet, may God bless him and grant him peace, and others is that Expiation before breaking the oath is sufficient. This is the opinion of Malik bin Anas, Al-Shafi’i, Ahmad, and Ishaq. Some people of knowledge said no. He is to disbelieve only after breaking the oath. Sufyan al-Thawri said: If he disbelieves after breaking the oath, it is more beloved to me, and if he disbelieves before breaking the oath, it will be sufficient for him.
