حَدَّثَنَا مَحْمُودُ بْنُ غَيْلاَنَ، حَدَّثَنَا عَبْدُ الصَّمَدِ بْنُ عَبْدِ الْوَارِثِ، حَدَّثَنِي أَبِي وَحَمَّادُ بْنُ سَلَمَةَ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ حَلَفَ عَلَى يَمِينٍ فَقَالَ إِنْ شَاءَ اللَّهُ فَقَدِ اسْتَثْنَى فَلاَ حِنْثَ عَلَيْهِ ‏"‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ أَبِي هُرَيْرَةَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ حَسَنٌ ‏.‏ وَقَدْ رَوَاهُ عُبَيْدُ اللَّهِ بْنُ عُمَرَ وَغَيْرُهُ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ مَوْقُوفًا ‏.‏ وَهَكَذَا رُوِيَ عَنْ سَالِمٍ عَنِ ابْنِ عُمَرَ رضى الله عنهما مَوْقُوفًا ‏.‏ وَلاَ نَعْلَمُ أَحَدًا رَفَعَهُ غَيْرَ أَيُّوبَ السَّخْتِيَانِيِّ وَقَالَ إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ وَكَانَ أَيُّوبُ أَحْيَانًا يَرْفَعُهُ وَأَحْيَانًا لاَ يَرْفَعُهُ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ أَنَّ الاِسْتِثْنَاءَ إِذَا كَانَ مَوْصُولاً بِالْيَمِينِ فَلاَ حِنْثَ عَلَيْهِ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَالأَوْزَاعِيِّ وَمَالِكِ بْنِ أَنَسٍ وَعَبْدِ اللَّهِ بْنِ الْمُبَارَكِ وَالشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ ‏.‏
Mahmoud bin Ghaylan narrated to us, Abd al-Samad bin Abd al-Warith narrated to us, my father and Hammad bin Salamah narrated to me, on the authority of Ayyub, on the authority of Nafi’, on the authority of Ibn Omar, that the Messenger of God, may God bless him and grant him peace, said, “Whoever takes an oath and says, God willing, has made an exception, so he will not break it.” He said. And in the chapter on the authority of Abu Hurairah. Abu Issa said the hadith of Ibn Umar is a hasan hadith. Ubayd Allah ibn Umar and others narrated it on the authority of Nafi’ on the authority of Ibn Omar is considered a mawqoof. And thus it was narrated on the authority of Salim on the authority of Ibn Omar, may God be pleased with them both, and we do not know of anyone who attributed it except Ayyub. Al-Sakhtiyani, and Ismail bin Ibrahim said: Ayoub sometimes raised it and sometimes he did not raise it. This is acted upon by most people. The people of knowledge among the Companions of the Prophet, may God bless him and grant him peace, and others, say that if the exception is connected to an oath, then he does not break it, and it is The saying of Sufyan Al-Thawri, Al-Awza’i, Malik bin Anas, Abdullah bin Al-Mubarak, Al-Shafi’i, Ahmad and Ishaq.
