حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا غُنْدَرٌ، حَدَّثَنَا سَعِيدُ بْنُ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ بْنِ جُنْدَبٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ
" أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلأَوَّلِ مِنْهُمَا وَمَنْ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَهُوَ لِلأَوَّلِ مِنْهُمَا " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ لاَ نَعْلَمُ بَيْنَهُمْ فِي ذَلِكَ اخْتِلاَفًا إِذَا زَوَّجَ أَحَدُ الْوَلِيَّيْنِ قَبْلَ الآخَرِ فَنِكَاحُ الأَوَّلِ جَائِزٌ وَنِكَاحُ الآخَرِ مَفْسُوخٌ وَإِذَا زَوَّجَا جَمِيعًا فَنِكَاحُهُمَا جَمِيعًا مَفْسُوخٌ . وَهُوَ قَوْلُ الثَّوْرِيِّ وَأَحْمَدَ وَإِسْحَاقَ .
Qutaibah narrated to us, Ghandar narrated to us, Sa’id bin Abi Orouba narrated to us, on the authority of Qatada, on the authority of Al-Hasan, on the authority of Samurah bin Jundub, that the Messenger God, may God’s prayers and peace be upon him, said: “Any woman whom a guardian marries, it belongs to the first of them, and whoever sells something to two men, it belongs to the first of them.” “Abu Issa said, ‘This is a good hadith. This is acted upon according to the people of knowledge. We do not know of any disagreement among them regarding this matter. One of the guardians got married before the other, so the marriage of the first is permissible and the marriage of the other is annulled. If they marry all of them, then the marriage of all of them is annulled. It is a saying Al-Thawri, Ahmad, and Ishaq.
