Jami' at-Tirmidhi — Hadith #27403

Wasil bin Abdul-Ala al-Kufi told us, Ibn Fudayl told us, on the authority of Yahya bin Saeed, on the authority of Nafi’, on the authority of Ibn Umar, he said: I heard the Messenger of God, may God’s prayers and peace be upon him, says: “A sale is at option unless they separate or choose.” He said, “When Ibn Umar made a purchase while he was He was sitting and got up to make the sale obligatory for him. Abu Issa said, and on the authority of Abu Barzah, Hakim bin Hazzam, Abdullah bin Abbas, and Abdullah Ibn Amr, Samurah, and Abu Hurairah. Abu Issa said: The hadith of Ibn Umar is a hasan authentic hadith, and this is acted upon according to some scholars from The Companions of the Prophet, may God bless him and grant him peace, and others. This is the opinion of Al-Shafi’i, Ahmad, and Ishaq, and they said that separation is with the bodies, not with the words. Some people of knowledge said that the meaning of the Prophet’s saying, may God bless him and grant him peace, “as long as they do not separate” means separation in speech. The first saying is more correct because Ibn Umar narrated on the authority of the Prophet, may God bless him and grant him peace, and he knows best the meaning of what he narrated and it was narrated on his authority that If he wanted to make the sale obligatory, he would go to make it obligatory for him, and this is how it was narrated on the authority of Abu Barzah Al-Aslami.
