حَدَّثَنَا بِذَلِكَ مُحَمَّدُ بْنُ بَشَّارٍ حَدَّثَنَا ابْنُ أَبِي عَدِيٍّ عَنْ حُسَيْنٍ الْمُعَلِّمِ عَنْ عَمْرِو بْنِ شُعَيْبٍ أَنَّهُ سَمِعَ طَاوُسًا يُحَدِّثُ عَنِ ابْنِ عُمَرَ وَابْنِ عَبَّاسٍ يَرْفَعَانِ الْحَدِيثَ إِلَى النَّبِيِّ صلى الله عليه وسلم بِهَذَا الْحَدِيثِ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عَبَّاسٍ رضى الله عنهما حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ قَالُوا مَنْ وَهَبَ هِبَةً لِذِي رَحِمٍ مَحْرَمٍ فَلَيْسَ لَهُ أَنْ يَرْجِعَ فِيهَا وَمَنْ وَهَبَ هِبَةً لِغَيْرِ ذِي رَحِمٍ مَحْرَمٍ فَلَهُ أَنْ يَرْجِعَ فِيهَا مَا لَمْ يُثَبْ مِنْهَا ‏.‏ وَهُوَ قَوْلُ الثَّوْرِيِّ ‏.‏ وَقَالَ الشَّافِعِيُّ لاَ يَحِلُّ لأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً فَيَرْجِعَ فِيهَا إِلاَّ الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ ‏.‏ وَاحْتَجَّ الشَّافِعِيُّ بِحَدِيثِ عَبْدِ اللَّهِ بْنِ عُمَرَ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ "‏ لاَ يَحِلُّ لأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً فَيَرْجِعَ فِيهَا إِلاَّ الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ ‏"‏ ‏.‏
Muhammad ibn Bashar narrated to us that, Ibn Abi Adi narrated to us, on the authority of Husayn al-Mu’allim, on the authority of Amr ibn Shuaib, that he heard Tawus speaking on the authority of Ibn Omar and Ibn Abbas conveyed the hadith to the Prophet, may God bless him and grant him peace, with this hadith. Abu Issa said the hadith of Ibn Abbas, may God be pleased with them both. A hasan and authentic hadith. This hadith is acted upon according to some people of knowledge among the companions of the Prophet, may God bless him and grant him peace, and others. They said: Whoever gives a gift He who has a mahram relative has no right to take it back, and whoever gives a gift to someone other than a mahram relative may take it back unless he returns from it. This is the opinion of Al-Thawri. Al-Shafi’i said: It is not permissible for anyone to give a gift and take it back, except the father in what he gives to his child. He protested. Al-Shafi’i, according to the hadith of Abdullah bin Omar, on the authority of the Prophet, may God’s prayers and peace be upon him, said: “It is not permissible for anyone to give a gift and then take it back.” Except for the father in what he gives to his child.”
