حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، حَدَّثَنَا هَمَّامٌ، عَنْ قَتَادَةَ، عَنْ أَنَسٍ، قَالَ خَرَجَتْ جَارِيَةٌ عَلَيْهَا أَوْضَاحٌ فَأَخَذَهَا يَهُودِيٌّ فَرَضَخَ رَأْسَهَا بِحَجَرٍ وَأَخَذَ مَا عَلَيْهَا مِنَ الْحُلِيِّ . قَالَ فَأُدْرِكَتْ وَبِهَا رَمَقٌ فَأُتِيَ بِهَا النَّبِيُّ صلى الله عليه وسلم فَقَالَ " مَنْ قَتَلَكِ أَفُلاَنٌ " . قَالَتْ بِرَأْسِهَا لاَ . قَالَ " فَفُلاَنٌ " . حَتَّى سُمِّيَ الْيَهُودِيُّ فَقَالَتْ بِرَأْسِهَا أَىْ نَعَمْ . قَالَ فَأُخِذَ فَاعْتَرَفَ فَأَمَرَ بِهِ رَسُولُ اللَّهِ صلى الله عليه وسلم فَرُضِخَ رَأْسُهُ بَيْنَ حَجَرَيْنِ . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ . وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ لاَ قَوَدَ إِلاَّ بِالسَّيْفِ .
Ali bin Hajar narrated to us, Yazid bin Harun narrated to us, Hammam narrated to us, on the authority of Qatada, on the authority of Anas, he said, “A girl came out wearing scarves.” Then a Jew took her, smashed her head with a stone, and took the jewelry on her. He said, “Then she was brought to her senses, and there was blood on her, so she was brought to the Prophet, may God’s prayers and peace be upon him.” And peace be upon him He said, “The person who killed you was so-and-so.” She said, shaking her head, “No.” He said, “So-and-so,” until the Jew was named. She said, shaking her head. Yes, he said, so he was taken and confessed, so the Messenger of God, may God bless him and grant him peace, ordered him to be buried between two stones. Abu Issa said: This is a good hadith. True. This is acted upon according to some people of knowledge, and it is the view of Ahmad and Ishaq. Some of the people of knowledge said: There is no fuel except by the sword.
