Hadith #27720
حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، بِهَذَا الإِسْنَادِ نَحْوَهُ . وَفِي الْبَابِ عَنْ عَوْفِ بْنِ مَالِكٍ، وَخَالِدِ بْنِ الْوَلِيدِ، وَأَنَسٍ، وَسَمُرَةَ بْنِ جُنْدَبٍ، . وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ . وَأَبُو مُحَمَّدٍ هُوَ نَافِعٌ مَوْلَى أَبِي قَتَادَةَ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ وَهُوَ قَوْلُ الأَوْزَاعِيِّ وَالشَّافِعِيِّ وَأَحْمَدَ . وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ لِلإِمَامِ أَنْ يُخْرِجَ مِنَ السَّلَبِ الْخُمُسَ . وَقَالَ الثَّوْرِيُّ النَّفَلُ أَنْ يَقُولَ الإِمَامُ مَنْ أَصَابَ شَيْئًا فَهُوَ لَهُ وَمَنْ قَتَلَ قَتِيلاً فَلَهُ سَلَبُهُ فَهُوَ جَائِزٌ وَلَيْسَ فِيهِ الْخُمُسُ . وَقَالَ إِسْحَاقُ السَّلَبُ لِلْقَاتِلِ إِلاَّ أَنْ يَكُونَ شَيْئًا كَثِيرًا فَرَأَى الإِمَامُ أَنْ يُخْرِجَ مِنْهُ الْخُمُسَ كَمَا فَعَلَ عُمَرُ بْنُ الْخَطَّابِ .
Ibn Abi Umar narrated to us, Sufyan bin Uyaynah narrated to us, on the authority of Yahya bin Saeed, with this chain of transmission and similar to it. And in the chapter on the authority of Awf bin Malik, Khaled ibn al-Walid, Anas, and Samurah ibn Jundub. This is a hasan and authentic hadith. Abu Muhammad is Nafi’, a servant. Abu Qatada... This is the view of some people of knowledge among the Companions of the Prophet, may God bless him and grant him peace, and others, and it is the view of Al-Awza’i, Al-Shafi’i, and Ahmad. Some of the people of knowledge told the imam to pay the five plunders. Al-Thawri said the supererogatory act is for the imam to say whoever afflicts something. So it is his. And whoever kills a person, his plunder is his. It is permissible, but the fifth is not included in it. And Ishaq said, plunder is for the killer unless it is a large thing. The imam decided to take out the fifth, as Omar ibn al-Khattab did.
