Jami' at-Tirmidhi — Hadith #27722

Muhammad ibn Yahya al-Naysaburi told us, Abu Asim al-Nabil told us, on the authority of Wahb Abi Khalid, he said, Umm Habiba bint Irbad ibn Saria, that her father told her that the Messenger of God, may God bless him and grant him peace, forbade the intercourse with the captives until they put what is in their bellies. He said: Abu Issa, and on the authority of Ruwaifa bin Thabit, and the hadith of Irbad is a strange hadith. This is acted upon according to the people of knowledge, and he said Al-Awza’i: If a man buys a slave girl from captivity while she is pregnant, it was narrated on the authority of Omar Ibn Al-Khattab that he said: Do not have intercourse with a pregnant woman until she gives birth. Al-Awza’i said: As for the free women, the Sunnah established that they were ordered to perform the waiting period. He said: “Ali bin Khashram told me about that.” He said: “Inform us.” Issa bin Yunus, on the authority of Al-Awza’i.
