حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ، حَدَّثَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي ابْنُ شِهَابٍ، قَالَ حَدَّثَنِي سُلَيْمَانُ بْنُ يَسَارٍ، عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ، عَنِ الْفَضْلِ بْنِ عَبَّاسٍ، أَنَّ امْرَأَةً، مِنْ خَثْعَمٍ قَالَتْ يَا رَسُولَ اللَّهِ إِنَّ أَبِي أَدْرَكَتْهُ فَرِيضَةُ اللَّهِ فِي الْحَجِّ وَهُوَ شَيْخٌ كَبِيرٌ لاَ يَسْتَطِيعُ أَنْ يَسْتَوِيَ عَلَى ظَهْرِ الْبَعِيرِ . قَالَ
" حُجِّي عَنْهُ " . قَالَ وَفِي الْبَابِ عَنْ عَلِيٍّ وَبُرَيْدَةَ وَحُصَيْنِ بْنِ عَوْفٍ وَأَبِي رَزِينٍ الْعُقَيْلِيِّ وَسَوْدَةَ بِنْتِ زَمْعَةَ وَابْنِ عَبَّاسٍ . قَالَ أَبُو عِيسَى حَدِيثُ الْفَضْلِ بْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ . وَرُوِيَ عَنِ ابْنِ عَبَّاسٍ عَنْ حُصَيْنِ بْنِ عَوْفٍ الْمُزَنِيِّ عَنِ النَّبِيِّ صلى الله عليه وسلم . وَرُوِيَ عَنِ ابْنِ عَبَّاسٍ أَيْضًا عَنْ سِنَانِ بْنِ عَبْدِ اللَّهِ الْجُهَنِيِّ عَنْ عَمَّتِهِ عَنِ النَّبِيِّ صلى الله عليه وسلم . وَرُوِيَ عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ صلى الله عليه وسلم . قَالَ وَسَأَلْتُ مُحَمَّدًا عَنْ هَذِهِ الرِّوَايَاتِ فَقَالَ أَصَحُّ شَيْءٍ فِي هَذَا الْبَابِ مَا رَوَى ابْنُ عَبَّاسٍ عَنِ الْفَضْلِ بْنِ عَبَّاسٍ عَنِ النَّبِيِّ صلى الله عليه وسلم . قَالَ مُحَمَّدٌ وَيَحْتَمِلُ أَنْ يَكُونَ ابْنُ عَبَّاسٍ سَمِعَهُ مِنَ الْفَضْلِ وَغَيْرِهِ عَنِ النَّبِيِّ صلى الله عليه وسلم ثُمَّ رَوَى هَذَا عَنِ النَّبِيِّ صلى الله عليه وسلم وَأَرْسَلَهُ وَلَمْ يَذْكُرِ الَّذِي سَمِعَهُ مِنْهُ . قَالَ أَبُو عِيسَى وَقَدْ صَحَّ عَنِ النَّبِيِّ صلى الله عليه وسلم فِي هَذَا الْبَابِ غَيْرُ حَدِيثٍ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ وَبِهِ يَقُولُ الثَّوْرِيُّ وَابْنُ الْمُبَارَكِ وَالشَّافِعِيُّ وَأَحْمَدُ وَإِسْحَاقُ يَرَوْنَ أَنْ يُحَجَّ عَنِ الْمَيِّتِ . وَقَالَ مَالِكٌ إِذَا أَوْصَى أَنْ يُحَجَّ عَنْهُ حُجَّ عَنْهُ . وَقَدْ رَخَّصَ بَعْضُهُمْ أَنْ يُحَجَّ عَنِ الْحَىِّ إِذَا كَانَ كَبِيرًا أَوْ بِحَالٍ لاَ يَقْدِرُ أَنْ يَحُجَّ . وَهُوَ قَوْلُ ابْنِ الْمُبَارَكِ وَالشَّافِعِيِّ .
Ahmad bin Mani’ told us, Ruh bin Ubadah told us, Ibn Jurayj told us, Ibn Shihab told me, he said Sulayman bin Yasar told me, On the authority of Abdullah bin Abbas, on the authority of Al-Fadl bin Abbas, that a woman from Khath’am said, “O Messenger of God, the duty of God has reached my father.” During Hajj, he was an old man and could not stand upright on the back of a camel. He said, “Perform Hajj on his behalf.” He said, on the authority of Ali. And Buraydah, Husayn bin Awf, Abu Razin Al-Uqaili, Sawda bint Zamah, and Ibn Abbas. Abu Issa said the hadith of Al-Fadl bin Abbas Hadith Hassan Sahih. It was narrated on the authority of Ibn Abbas, on the authority of Husayn bin Awf Al-Muzani, on the authority of the Prophet, may God bless him and grant him peace. It was also narrated on the authority of Ibn Abbas, on the authority of Sinan Bin Abdullah Al-Juhani, on the authority of his paternal aunt, on the authority of the Prophet, may God bless him and grant him peace. It was narrated on the authority of Ibn Abbas, on the authority of the Prophet, may God bless him and grant him peace. He said I asked Muhammad about these narrations, and he said, “The most correct thing in this regard is what Ibn Abbas narrated on the authority of Al-Fadl Ibn Abbas, on the authority of the Prophet, may God bless him and grant him peace.” Muhammad said, and it is possible that Ibn Abbas heard it from Al-Fadl and others on the authority of the Prophet, may God bless him and grant him peace, and then he narrated this on the authority of The Prophet, may God’s prayers and peace be upon him, sent him, but he did not mention what he heard from him. Abu Issa said, and there is not a single hadith authenticated on the authority of the Prophet, may God’s prayers and peace be upon him, in this matter. This is acted upon by the people of knowledge among the Companions of the Prophet, may God bless him and grant him peace, and others, and this is what Al-Thawri and Ibn Al-Thawri say. Al-Mubarak, Al-Shafi’i, Ahmad, and Ishaq are of the opinion that Hajj be performed on behalf of the dead. Malik said: If he recommends that Hajj be performed on his behalf, Hajj should be performed on his behalf. Some of them have granted permission to perform Hajj on behalf of a living person if he is old or in a condition where he is not able to perform Hajj. This is the saying of Ibn Al-Mubarak. And Al-Shafi’i.
