حَدَّثَنَا زِيَادُ بْنُ أَيُّوبَ الْبَغْدَادِيُّ، حَدَّثَنَا عَبَّادُ بْنُ عَوَّامٍ، عَنْ هِلاَلِ بْنِ خَبَّابٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ ضُبَاعَةَ بِنْتَ الزُّبَيْرِ، أَتَتِ النَّبِيَّ صلى الله عليه وسلم فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي أُرِيدُ الْحَجَّ أَفَأَشْتَرِطُ قَالَ " نَعَمْ " . قَالَتْ كَيْفَ أَقُولُ قَالَ " قُولِي لَبَّيْكَ اللَّهُمَّ لَبَّيْكَ لَبَّيْكَ مَحِلِّي مِنَ الأَرْضِ حَيْثُ تَحْبِسُنِي " . قَالَ وَفِي الْبَابِ عَنْ جَابِرٍ وَأَسْمَاءَ بِنْتِ أَبِي بَكْرٍ وَعَائِشَةَ . قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ يَرَوْنَ الاِشْتِرَاطَ فِي الْحَجِّ وَيَقُولُونَ إِنِ اشْتَرَطَ فَعَرَضَ لَهُ مَرَضٌ أَوْ عُذْرٌ فَلَهُ أَنْ يَحِلَّ وَيَخْرُجَ مِنْ إِحْرَامِهِ . وَهُوَ قَوْلُ الشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ . وَلَمْ يَرَ بَعْضُ أَهْلِ الْعِلْمِ الاِشْتِرَاطَ فِي الْحَجِّ وَقَالُوا إِنِ اشْتَرَطَ فَلَيْسَ لَهُ أَنْ يَخْرُجَ مِنْ إِحْرَامِهِ . وَيَرَوْنَهُ كَمَنْ لَمْ يَشْتَرِطْ .
Ziyad bin Ayyub Al-Baghdadi told us, Abbad bin Awwam told us, on the authority of Hilal bin Khabab, on the authority of Ikrimah, on the authority of Ibn Abbas, that Duba'ah bint Al-Zubayr, she came to the Prophet, may God bless him and grant him peace, and said, “O Messenger of God, I want to perform Hajj. Should I stipulate?” He said, “Yes.” She said, “How?” I say, he said, “Say, ‘Labbayk, O God, Labbayk, my abode from the land where you imprison me.’” He said, and in the chapter on the authority of Jabir and Asma’ The daughter of Abu Bakr and Aisha. Abu Issa said: The hadith of Ibn Abbas is a hasan and authentic hadith. This is acted upon according to some people of knowledge. They see The stipulation for Hajj, and they say that if he stipulates it and he suffers an illness or an excuse, then he has the right to permissible it and leave his ihram. This is the opinion of Al-Shafi’i. And Ahmad and Ishaq. Some of the people of knowledge did not consider Hajj to be a stipulation, and they said that if he stipulated, then he does not have the right to leave his ihram. They see him as someone who did not stipulate.
