حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا إِسْحَاقُ بْنُ يُوسُفَ الأَزْرَقُ، عَنْ هِشَامٍ الدَّسْتَوَائِيِّ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، عَنْ أَبِي قِلاَبَةَ، عَنْ ثَابِتِ بْنِ الضَّحَّاكِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم
" مَنْ حَلَفَ بِمِلَّةٍ غَيْرِ الإِسْلاَمِ كَاذِبًا فَهُوَ كَمَا قَالَ " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ . وَقَدِ اخْتَلَفَ أَهْلُ الْعِلْمِ فِي هَذَا إِذَا حَلَفَ الرَّجُلُ بِمِلَّةٍ سِوَى الإِسْلاَمِ فَقَالَ هُوَ يَهُودِيٌّ أَوْ نَصْرَانِيٌّ إِنْ فَعَلَ كَذَا وَكَذَا فَفَعَلَ ذَلِكَ الشَّىْءَ فَقَالَ بَعْضُهُمْ قَدْ أَتَى عَظِيمًا وَلاَ كَفَّارَةَ عَلَيْهِ وَهُوَ قَوْلُ أَهْلِ الْمَدِينَةِ وَبِهِ يَقُولُ مَالِكُ بْنُ أَنَسٍ وَإِلَى هَذَا الْقَوْلِ ذَهَبَ أَبُو عُبَيْدٍ . وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَالتَّابِعِينَ وَغَيْرِهِمْ عَلَيْهِ فِي ذَلِكَ الْكَفَّارَةُ وَهُوَ قَوْلُ سُفْيَانَ وَأَحْمَدَ وَإِسْحَاقَ .
Ahmad ibn Mani` told us, Ishaq ibn Yusuf al-Azraq told us, on the authority of Hisham al-Dastawai, on the authority of Yahya ibn Abi Kathir, on the authority of Abu Qalabah, on the authority of Thabit bin Al-Dahhak, who said that the Messenger of God, may God bless him and grant him peace, said, “Whoever swears by a religion other than Islam, falsely, is as he said.” He said. Abu Issa, this is a hasan and authentic hadith. The people of knowledge have differed on this matter. If a man swears by a religion other than Islam and says he is a Jew, Or a Christian, if he did such-and-such, and he did that thing, and some of them said, “He has committed a great sin, and there is no expiation for him.” This is the opinion of the people of Medina. This is what Malik bin Anas says, and Abu Ubaid went to this opinion. Some of the people of knowledge from the companions of the Prophet, may God bless him and grant him peace, and his followers said: Others have to offer expiation, and this is the view of Sufyan, Ahmad, and Ishaq.
