حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا قَبِيصَةُ، عَنْ جَرِيرِ بْنِ حَازِمٍ، عَنِ الزُّبَيْرِ بْنِ سَعِيدٍ، عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ بْنِ رُكَانَةَ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ أَتَيْتُ النَّبِيَّ صلى الله عليه وسلم فَقُلْتُ يَا رَسُولَ اللَّهِ إِنِّي طَلَّقْتُ امْرَأَتِي الْبَتَّةَ . فَقَالَ " مَا أَرَدْتَ بِهَا " . قُلْتُ وَاحِدَةً . قَالَ " وَاللَّهِ " . قُلْتُ وَاللَّهِ . قَالَ " فَهُوَ مَا أَرَدْتَ " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ لاَ نَعْرِفُهُ إِلاَّ مِنْ هَذَا الْوَجْهِ وَسَأَلْتُ مُحَمَّدًا عَنْ هَذَا الْحَدِيثِ فَقَالَ فِيهِ اضْطِرَابٌ . وَيُرْوَى عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ أَنَّ رُكَانَةَ طَلَّقَ امْرَأَتَهُ ثَلاَثًا . - وَقَدِ اخْتَلَفَ أَهْلُ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ فِي طَلاَقِ الْبَتَّةِ فَرُوِيَ عَنْ عُمَرَ بْنِ الْخَطَّابِ أَنَّهُ جَعَلَ الْبَتَّةَ وَاحِدَةً وَرُوِيَ عَنْ عَلِيٍّ أَنَّهُ جَعَلَهَا ثَلاَثًا . وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ فِيهِ نِيَّةُ الرَّجُلِ إِنْ نَوَى وَاحِدَةً فَوَاحِدَةٌ وَإِنْ نَوَى ثَلاَثًا فَثَلاَثٌ وَإِنْ نَوَى ثِنْتَيْنِ لَمْ تَكُنْ إِلاَّ وَاحِدَةً . وَهُوَ قَوْلُ الثَّوْرِيِّ وَأَهْلِ الْكُوفَةِ . وَقَالَ مَالِكُ بْنُ أَنَسٍ فِي الْبَتَّةِ إِنْ كَانَ قَدْ دَخَلَ بِهَا فَهِيَ ثَلاَثُ تَطْلِيقَاتٍ . وَقَالَ الشَّافِعِيُّ إِنْ نَوَى وَاحِدَةً فَوَاحِدَةٌ يَمْلِكُ الرَّجْعَةَ وَإِنْ نَوَى ثِنْتَيْنِ فَثِنْتَانِ وَإِنْ نَوَى ثَلاَثًا فَثَلاَثٌ .
Hanad narrated to us, Qabisa narrated to us, on the authority of Jarir bin Hazim, on the authority of Al-Zubayr bin Saeed, on the authority of Abdullah bin Yazid bin Rukana, on the authority of His father, on the authority of his grandfather, said, “I came to the Prophet, may God’s prayers and peace be upon him, and said, ‘O Messenger of God, I have divorced my wife absolutely.’ He said, ‘I did not want it with her.’” I said one thing. He said, “By God.” I said, “By God.” He said, “It is what you wanted.” Abu Issa said, “This is a hadith that we do not know.” Except from this perspective. I asked Muhammad about this hadith and he said there is confusion in it. It is narrated on the authority of Ikrimah on the authority of Ibn Abbas that Rukana divorced His wife, three times. - The scholars, including the companions of the Prophet, may God bless him and grant him peace, and others, differed regarding absolute divorce. It was narrated on the authority of Omar ibn al-Khattab. He made the bit one, and it was narrated on the authority of Ali that he made it three. Some of the people of knowledge said that it is the intention of the man if he intends One, then one, and if he intended three, then three, and if he intended two, then it is only one. This is the saying of Al-Thawri and the people of Kufa. Malik ibn Anas said that if he had consummated the marriage with her, then it is three divorces.
